He felt
there should be IrOre study done by the developer regarding the size of ponds
that are required. He stated that he was not being critical of Mr. Honchell,
but he didn't feel the City Engineer had the tirre or the manpaver to corrplete
the study of the need for pending on the property.

Mr. John Murlavski indicated that it was aJ1rost a certainty that Rice Creek
was going to be building the proj ect and he did not want to go to all the
expense of having another study made. He also indicated that Mr. Honchell
had reviewed the size ponds that were required.

RecOITitendation

Mr. G. Johnson IrOved that the Commission recal'il'rel1d approval of Murlavski &
Feiling's request for preliminary plat between Josephine Road, County Road C-2,
Lexington and Merrill, with the follaving conditions:

1. 'Ihat adequate interim ponding be provided on the property
until the Rice Creek Watershed District completes construction
of its drainage project.

2. 'Ihat the necessary utility easerrents be provided as required by the
Public ~\Torks Director.

The IrOtion died for lack of a second.

Mr. Rukavina IrOved and Mr. SiIIDns seconded, that Murlavski & Feilings' s request
for preliminary plat between Josephine Road, County Road C-2, Iexington and
Merrill be continued until the May 3, 1978, Planning Ccmnission rreeting. The
continuation is to provide an opportunity for study of the appropriate size
for the interim ponds on the property. Poll Call, Ayes: Rukavina, Cushing,
Dressler and Sirrons. Nays: G. Johnson and V. Johnson. Abstain: Mastel.

Mr. V. Johnson indicated that he was also concerned about the need for
adequate ponding on the property, however, he felt this could have been handled
with a condition on the approval of the plat without continuing the application.

Mr. Mastel indicated that he abstained because he is presently constructing a
horre on one of the Murlavski lots on Josephine Road.
