<br />-3- <br /> <br />Plarurlng File 1136 - Rebert Daly request for special use pennit and variance to <br />parking and punp island setback at 1526 West County Road B <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated that the property in question is located at Snelling <br />and County Ibad B contiguous to the liar Mar Shopping Center. The applicant proposes <br />to upgrade and rencdel the building, enlarge the purrp island area, and to redesign <br />the parking layout. Mr. Dahlgren stated that the Conmission at its last neeting <br />had continued the application in order to pe:rmi t the liar Mar people to consider the <br />possibility of acquisition of the land and incorporation of the property into the liar <br />Mar Center developn:ent. Such acquisition would appear to be in the interest of the <br />City, but to date negotiations have not been successful. The variance is required <br />since no side yard setback is proposed on the easterly perirreter of the site. In <br />addition, the applicant proposes to locate a punp island l4~ feet fran the property <br />line as opposed to 25 feet as required. Mr. Dahlgren noted that the punp island to <br />the north is presently a non conforming use. <br /> <br />Mr. Bessler of Q Petroleum stated that they intended to rerrodel and inprove the <br />existing gas station site. He stated that there has been talk at liar Mar concerning <br />the trade of this site for another gas station site within the rretropolitan area. He <br />indicated that Q Petroleum was not interested in an outright sale but sane type of <br />property trade. <br /> <br />Discussion <br /> <br />Mr. V. Johnson stated that the Camd.ssion had received a letter fran Marie Slawik, <br />President of Har Mar Corporation, requesting that the Conmission grant another <br />extension in order to allow further negotiations between the two parties. Mrs. Slawik <br />said that liar Mar has made bona fide attenpts to purchase the property. She also <br />reviewed the histo:ry of the negotiations between the two parties. She stated that a <br />one nonth extension would pe:rmit liar Mar to review a mmber of alternatives in greater <br />detail. <br /> <br />Mr. V. Johnson stated that the role of the Cornnission is to advise the Council on the <br />best and highest use of property in the carmunity. He felt that the Ccmnission might <br />possibly be getting involved as an mrpire in the negotiations which is not the role <br />of the eomnission. <br /> <br />Mr. Dahlgren stated he felt it was desirable fran the City's point of view to pennit <br />a different use of the site. He stated that he had conversations with Mr. Daly and <br />he indicated a desire to trade the site, but expressed an interest in not delaying <br />any further. <br /> <br />Mr. Dahlgren suggested that if the CoImd.ssion wishes to continue this i tern to October <br />it nay wish to ask the Council to establish its public hearing for October 11. <br /> <br />Mr. SiIIDns asked whether the Cam1ission should be considering the neri ts of the <br />proposed variances and the special use portion or should it be concerned with the <br />location of the building and the negotiations between the two parties. Mr. Dahlgren <br />stated that Mr. SiIrons made a good point, the principal issue is the variance and <br />whether the special use pennit should be issued. The secondary question is whether <br />a station should be on the site at all. <br /> <br />Mr. Mastel asked if the prinary purpose of the site was gasoline or grocery items? <br />
