-3-

Plarurlng File 1136 - Rebert Daly request for special use pennit and variance to
parking and punp island setback at 1526 West County Road B

Presentation

Mr. Dahlgren indicated that the property in question is located at Snelling
and County Ibad B contiguous to the liar Mar Shopping Center. The applicant proposes
to upgrade and rencdel the building, enlarge the purrp island area, and to redesign
the parking layout. Mr. Dahlgren stated that the Conmission at its last neeting
had continued the application in order to pe:rmi t the liar Mar people to consider the
possibility of acquisition of the land and incorporation of the property into the liar
Mar Center developn:ent. Such acquisition would appear to be in the interest of the
City, but to date negotiations have not been successful. The variance is required
since no side yard setback is proposed on the easterly perirreter of the site. In
addition, the applicant proposes to locate a punp island l4~ feet fran the property
line as opposed to 25 feet as required. Mr. Dahlgren noted that the punp island to
the north is presently a non conforming use.

Mr. Bessler of Q Petroleum stated that they intended to rerrodel and inprove the
existing gas station site. He stated that there has been talk at liar Mar concerning
the trade of this site for another gas station site within the rretropolitan area. He
indicated that Q Petroleum was not interested in an outright sale but sane type of
property trade.

Discussion

Mr. V. Johnson stated that the Camd.ssion had received a letter fran Marie Slawik,
President of Har Mar Corporation, requesting that the Conmission grant another
extension in order to allow further negotiations between the two parties. Mrs. Slawik
said that liar Mar has made bona fide attenpts to purchase the property. She also
reviewed the histo:ry of the negotiations between the two parties. She stated that a
one nonth extension would pe:rmit liar Mar to review a mmber of alternatives in greater
detail.

Mr. V. Johnson stated that the role of the Cornnission is to advise the Council on the
best and highest use of property in the carmunity. He felt that the Ccmnission might
possibly be getting involved as an mrpire in the negotiations which is not the role
of the eomnission.

Mr. Dahlgren stated he felt it was desirable fran the City's point of view to pennit
a different use of the site. He stated that he had conversations with Mr. Daly and
he indicated a desire to trade the site, but expressed an interest in not delaying
any further.

Mr. Dahlgren suggested that if the CoImd.ssion wishes to continue this i tern to October
it nay wish to ask the Council to establish its public hearing for October 11.

Mr. SiIIDns asked whether the Cam1ission should be considering the neri ts of the
proposed variances and the special use portion or should it be concerned with the
location of the building and the negotiations between the two parties. Mr. Dahlgren
stated that Mr. SiIrons made a good point, the principal issue is the variance and
whether the special use pennit should be issued. The secondary question is whether
a station should be on the site at all.

Mr. Mastel asked if the prinary purpose of the site was gasoline or grocery items?
