Mr. Wenger stated that it was his intent to tear the garage dam <br />at the tiIre he sold the property. <br /> <br />Mr. Rukavina asked if the applicant was presently using the garage for storage of <br />tcwing trucks and if so, was this use grand fathered in. <br /> <br />Mr. ~nger stated that he did store trucks at the site and had done so for a mmber <br />of years. He indicated thatit was his intent, in the near future, to get out of this <br />business. <br /> <br />Mr. Rukavina asked if the applicant was in the process of constructing any building on <br />the site at the present tine. <br /> <br />Mr. ~nger stated that he was not but was rroving the 12 x 20 garage from the northerly <br />lot to the lot to the west. <br /> <br />:Eecomrendation <br /> <br />Mr. Rukavina rroved, Mrs. Cushing seconded, that the Comnission recormend approval of <br />Carl Wenger's request for preliminary plat at 2941 Victoria Avenue with the conditions <br />that: <br /> <br />A. '!hat 10 feet of additional right-of-way be dedicated on Victoria <br />B. '!hat 10 foot drainage easerrents be provided on the center lot lines <br />C. Nays: None. <br /> <br />Planning File 1152 - Continental Oil request for special use permit and division <br />of lot at 2815 Rice Street <br /> <br />Presentation <br /> <br />Mr. Dahlgren stated the applicant proposes to construct a self service gas station <br />with a convenience store to be locatEd. adjacent to the apartrrent conplex. Mr. Dahlgren <br />also indicated that the applicant proposes to divide the lot so as to be able to add an <br />addi tional 50 feet of property to the south, thereby leaving 130 feet frontage for the <br />proposed developrrent. The apartrrent buildings were planned and previously approved as a <br />planned unit development and included a small convenience shopping area. The approved <br />PUD incorporated a private frontage road with two dri veNays . Mr. Dahlgren stated that <br />the proposal rreets the City's parking and setback requirerrents. He did note that it <br />appeared from the plans that the rear of the building was COI'CIron bond brick rather than <br />the stack bound brick as proposed on the other three sides. He suggested that the <br />exterior of the building be constructed the SartE on all four sides. He also suggested <br />that the Cooroission maintain the private frontage road with two dri veNays as approved <br />in the original PUD. <br /> <br />Mr. Kenneth Ingram, representing Conintental Oil, stated that the proposed property was <br />purchased in 1970 with intent to build a gas station/convenience store on the site. <br />He noted that in 1970 the application had been approved by the City, but because of <br />financing difficulties the project was not constructed. He stated at this tine 180 <br />feet of frontage was not necessary and that they propose to sell the remaining 50 feet <br />to the adjacent land which woold permit the developrrent of the property to the south. <br />Mr. Ingram stated that, in his opinion, providing only two entrances to the apa.rtn'ent <br />building and gas station site by the frontage road was not appropriate and said he felt <br />approval for a third entrance could be obtained from the state.
