<br />~5- <br /> <br />Mr. Novak indicated that the proposed parking lot would be a 5% grade but the main <br />question related to the future deve10prrent of the easerrent on the south which has a <br />present grade of 14%. <br /> <br />Mr. SirrDn suggested that the Corrmission nay wish to consider continuing this matter <br />and also requesting that the Council establish a public hearing for Noverrber 13. He <br />suggested by doing so the applicant would not experience any tine delay and the <br />Conmission could have a chance to review the application again. <br /> <br />Mrs. Cushing expressed her concern of requiring the neighbors to attend two rreetings <br />and stated she felt comfortable with recanrending approval of the application with <br />appropriate conditions. <br /> <br />Mr. Rukavina stated he would be opposed to approving the application with conditions <br />and questioned why the applicant did not provide the necessary information requested <br />fran the staff. <br /> <br />Mr. M:x1er, 162 Minnesota Avenue, stated that he had submitted a letter expressing his <br />ooncerns regarding the lighting, landscaping and other problems at the Country Kitchen <br />site. He requested that the landscaping be prepared in greater detail before the <br />CoIrmission approve the request. <br /> <br />Mr. G. Johnson noted that the Conroission had received Mr. MJder's letter and copies <br />of the letter had been distributed to the Corrrnission. <br /> <br />Mr. Ien Richter, prcperty CMl1.er directly to the south of Country Kitchen, expressed his <br />concerns with the lights fran the parking lot, the lack of screening on the southern site <br />of the property, the feasibility of actually constructing the roadway as proposed. He <br />noted that he has had difficulties previously with drainage going onto his property from <br />the Country Kitchen site. He asked, because of these difficulties, the Conmission con- <br />sider continuing the application. <br /> <br />Recomrendation <br /> <br />Mr. Sirrons rroved, Mr. Mastel seconded, that the Commission continue Country Kitchen's <br />request for rezoning from R-6 to B-2 and division of lot at 2257 Rice Street until the <br />Novenber 1, 1978 rreeting and also ::recamended that the Council establish a public hearing <br />on the matter for Noverrber 13, 1978. FoIl Call, Ayes: Cushing, Simms, Rukavina, <br />Dressler, Mastel, G. Johnson. Nays: None. <br /> <br />Plarming File 1143 - Kathleen Waxberg request for special use permit at 2923 Pascal <br />Aven\E <br /> <br />Mr. Dahlgren indicated that recently Mrs. Waxberg petitioned the City Council to anend <br />the zoning ordinance to allav a one operator beauty shop as a special use in R-l or <br />R- 2 districts. 'Ihe Council subsequently arrended the ordinance accordingly. Mrs. Wamerg <br />is applying for a special use permit to operate a one operator shop in the basenent of her <br />hone. <br /> <br />Mr. Dahlgren indicated that the principal concerns for such operations nonnally involve <br />the effect on traffic and parking wi thin the area. He pointed out the fact that <br />nUIrerOUS court cases have ruled against a municipality from using the zoning as a nethod <br />of restricting catpetition. <br /> <br />Mrs. Wamerg, the applicant, stated she proposes to use the basenent of her single family <br />hone for a beauty parlor. She felt the twc car driveway would provide adequate parking <br />for the area and she indicated she did not intend to erect any signs on the site. She <br />
