-5-

Planning File 1284 - Sam Cave's request to amend the zoning ordinance by
adding schools of music and dance as a permitted use
in the B-1 (Limited Business District) zoning district

Presentation

Mr. Dahlgren indicated that Mr. Cave had recently built two office buildings
at the northwest corner of Rice and Transit which property was zoned B-1,
Limited Business. He further indicated that Mr. Cave had a perspective tenant
who proposed to conduct a dancing studio for children on the premises. Such
use is currently listed in the ordinance as permitted in the B-2 district.
The request is to permit the use in the B-1 district as a permitted use.

Discussion

Mrs. Cushing indicated that this was a similar situation with the dog grooming
and that the owner of the building should be the one concerned in this case
with the tenants and not necessarily the city.

Mr. Rukavina agreed and indicated that if the owner can handle it, so should
the city.

Recommendation

Mr. Rukavina moved and Mrs. Cushing seconded, that the Commission recommend
approval of Sam Cave's request to amend the zoning ordinance, but that the
addition be for adding schools of music and dance as a special use in the B-1
(Limited Business) zoning district. Roll Call, Ayes: Rukavina, Simons,
Cushing, Dressler, G. Johnson. Nays: None.

Planning File 1264 - Proposed Ordinance Defining Certain Uses in R-l District
and Adding Criteria For Issuances of Special Use Permit

Discussion

Mr. Dahlgren indicated that the Attorney General's Opinion had been received
by the City and that it had indicated general support for the City's position
in that the City seemed able to define uses in the R-l District as they pertain
to school property by zoning ordinance. He further indicated that no action
was requested of the Commission at this time and that the matter would come up
for discussion with comment at the next meeting of the Commission.

Recommendation

Mr. Rukavina moved and Mrs. Cushing seconded, that the matter of the proposed
ordinance be held over to the next regular Commission meeting. Roll Call,
Ayes: Rukavina, Simons, Cushing, Dressler, George Johnson. Nays: None.

Adjournment

Mr. Rukavina moved and Mrs. Dressler seconded that the meeting be adjourned
at 10:55 P.M. Roll Call, Ayes: Rukavina, Simons, Cushing, Dressler, G. Johnson.
Nays: None.
