<br />-2- <br /> <br />Recommendation <br /> <br />George Johnson moved and Mrs. Cushing seconded. that the Commission recommend <br />approval of Alex Minich request for rezoning from B-1 to R-3A. variance to <br />density and parking requirements, and that the applicant be given permission to <br />construct efficienty unit at 2980 North Snelling Avenue. Roll Call, Ayes: <br />Rukavina, Cushing, Dressler, George Johnson and Vern Johnson. Nays: None. <br /> <br />Planning File 1289 - Sam Cave request for preliminary and final plat and <br />variance at 3111Evelyn (Outlot A) <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated that several years ago the applicant had platted the North <br />Boundary Subdivision of which this property is a part. At that time the City pur- <br />chased drainage easement rights from Mr. Cave so as to retain the rights to pond <br />water on the property in question and the property immediately to the west. Sub- <br />sequently, Mr. Cave had a consulting engineer prepare drainage calculations which <br />indicated that not all the ponding area was necessary. He, therefore, is proposing <br />to purchase easement rights for the easterly 70 feet of the three lots proposed and <br />proposes to plat this land. Further, as with the other houses built along this <br />subdivision on Evelyn, Mr. Cave is requesting that the proposed houses be within <br />the 30 foot setback normally required at 25 feet. <br /> <br />Mr. Dahlgren referred to a letter dated November 5, 1980, from Mr. Cave in which <br />he outlined his proposal and what he agreed to do in regard to the drainage for <br />the ponding easement. ~1r. Drown indicated that in regard to this letter, he believed <br />that the vacation of 70 feet may change as ponding calculations become more definite <br />in that they may, indeed, have more than 70 feet available. <br /> <br />Further, because of the construction of the pond, disturbing the easterly portion <br />of the pond would cause the rest of the ponding area to change in character and <br />that grading would have to be done other than wher.ethe ponding area was disturbed. <br /> <br />Thirdly, because the land in that area is low, it is the City's policy to assess <br />for sewer at twice the amount normally charged; and fourth. there would be a <br />street light assessment since a light had been installed subsequent to the building <br />of the homes along Evelyn. So far as the reimbursement to Roseville of the original <br />price paid for the ponding easement, Mr. Drown indicated that this may also change <br />depending upon the size of the actual vacation of the easement. <br /> <br />Mr. Cave indicated that he did not feel the land would fall under the low land pro- <br />vision of the storm sewer charge. <br /> <br />Discussion <br /> <br />Mr. Rukavina indicated that he did not believe a change in the storm sewer charge <br />was appropriate for the Planning Commission and should be taken up by the Council. <br />He also asked what caused the change in the requirements for the ponding <br /> <br />Mr. Drown indicated that the original pond had been calculated without a storm <br />sewer outlet and since the addition of the outlet there was not the need for as <br />large as pond as was currently there. <br /> <br />Mrs. Julie Davis, resident on Evelyn, asked what happened to the promise by <br />Mr. Cave that a wildlife park would be maintained at this location. <br />
