<br />-3- <br /> <br />Mr. Cave indicated no such promise had been made. but at the time he had sold <br />her the home there, he did not believe he would be building on that property, <br />but had since changed his mind. <br /> <br />Vern Johnson asked that two letters received from residents in the area be read <br />into the record. <br /> <br />Mr. Payne then read the letter dated November 25, 1980, from Harlan B. Jensen, <br />3082 Evelyn Street, in which Mr. Jensen opposed the proposal based on his under- <br />standing that this would remain an open area and that because of the short back <br />yards of the proposed homes, there may be undesirable buyers in the area, <br /> <br />The second letter, dated November 23. 1980. from Robert and Julie Chudek of 3110 <br />Evelyn Street, indicated opposition to the proposal in that they had received <br />assurances from Mr. Cave that the lots across the street belonged to the City and <br />no homes would be built there. <br /> <br />Mr. Rukavina asked if the lots were big enough. Mr. Dahlgren indicated that the <br />total size of the lots was, indeed, large enough; however, if the easements line <br />as proposed was considered to be the lot line, the lots would be 7,000 rather than <br />the required 11,000 square feet. He further stated that this would only be a <br />factor when there was water in the ponding area. <br /> <br />Mrs. Davis indicated her opposition to the proposal at this time. <br /> <br />Mrs. Cushing indicated her concern for the neighbors that had been promised open <br />land in this area. <br /> <br />Mr. Rukavina stated that he did not believe the Commission could decide whether <br />promises had not been kept in this regard. <br /> <br />George Johnson stated his belief that the addition of homes would add to the <br />neighborhood in that land in that area would receive additional care. <br /> <br />Mrs. Dressler indicated she believed the homeowner was responsible for finding out <br />if the claims of the seller were true in regard to properties adjacent to homes <br />sold. <br /> <br />Vern Johnson indicated his belief that this would ultimately become an improvement <br />for the neighborhood. <br /> <br />Recommendation <br /> <br />Mr. Rukavina moved and Mr. George Johnson seconded, that the Commission t~commend <br />approval of the Sam Cave request for approval of preliminary plat and variance to <br />front yard setback at the southwest corner of County Road D and Evelyn Street. with <br />the conditions specified in the letter from Mr. Cave dated November 5, 1980, with <br />the exception that the applicant be required to put the entire ponding area in <br />proper condition and that the Council review the storm sewer charge and the possible <br />change to the vacation of easement; and therefore, the dollar amount reimbursed to <br />the City of Roseville for this vacation.
