<br />-4- <br /> <br />that the processing and packaging is done within an enclosed structure; and <br />sales offices relating thereto, as a special use in the I-l industrical district. <br />The property in question is the Yellow Freight Line facilities located just north <br />of the old Hart Motor Freight Company property between long lake Road and I-35W. <br />He further indicated that the staff had met with the applicant on several occasions <br />reviewing preliminary development plans and the use of it as it relates to the <br />zoning ordinance. At that time it had been determined that the code did not specific- <br />ally provide for the use intended in that the applicant should first request a change <br />to the ordinance providing for the use as a special use in the light industrial <br />district. It is the intent of the applicant to process and package various <br />industrial and specialty type gases at this location. The City's Fire Marshal <br />reviewed the application in staff conferences and had indicated he felt there was <br />no objection to the use from a fire protection standpoint, assuming that the <br />required safeguards are installed. The applicant has indicated a willingness to <br />do whatever is necessary to make the site safe. <br /> <br />Further, the applicant proposes to do some additional construction on the site <br />which would include remodelling the building to some degree adding a new front <br />at the I-35 W side and building a new office building on the Long Lake Road side. <br /> <br />Mr. Dahlgren indicated that while this does not entirely convert the land to strictly <br />business purposes as intended in the Comprehensive Plan, it does provide for sub- <br />stantial improvement to the site. Stress has been placed on the need to improve <br />the surfaces and landscaping the area, and the applicant has indicated a willingness <br />to do so. <br /> <br />Mr. Kunze, attorney for the applicant, indicated that since the plans had been <br />drawn up for the site, complying with the wishes of the staff,regarding upgrading <br />of the site. Mr. Dahlgren indicated that since this was the request to amend the <br />zoning ordinance, consideration should be given to the zoning ordinance change at <br />this time, and the site plans would be provided should the applicant apply for the <br />special use under the new ordinance. <br /> <br />Discussion <br /> <br />Mr. Johnson indicated his concern for possible negative impacts pertaining to the <br />aesthetic or environmental situation at the site. He was particularly concerned <br />about the proposed open storage for lime residue which is created during the manu- <br />facture of acetylene gas. <br /> <br />Mr. Garrett for the applicant, indicated that the holding pond which was indicated <br />in the application would be used only in an emergency situation when the tanks that <br />were contained within the structure were full for one reason or another. He in- <br />dicated that it was the intent of Union Carbide to sell the lime by-product as <br />quickly as it was produced and that there should not be a case where the lime was <br />put into the holding area. <br /> <br />Mr. Lemberg, architect for the applicant, further indicated that the holding pond <br />area was to be bermed around its circumference and that extensive plantings would <br />be made on these berms to mask the holding area as much as possible. <br /> <br />Mr. Rukavina inquired as to what the applicant considered to be an emergency, <br />where the lime by-product could be placed in the holding area. <br />
