<br />-3- <br /> <br />Planning File 1291 - Midwest Diesel request for variance to zoning ordinance <br />at 1743 West County Road C <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated that the applicant operates a truck repair service at this <br />location, having done so for the past five years. The property on which the <br />company is located was created in such a way that it is landlocked except for the <br />provision of the 50 foot public right-of-way extending northerly from County Road <br />C. This 50 feet is dedicated to the city but is maintained by the applicant. <br />He noted that the applicant desires to construct a sign on this right-of-way so as <br />to provide a means of identification from County Road C. Normally this would occur <br />on the applicant's property, however, since the property is some distance from the <br />road, the sign would not provide adequate identification. The proposed sign is to <br />be constructed 35 feet from the north right-of-way of County Road C and would be <br />located approximately one foot from the edge of the 50 foot right-of-way. The <br />total sign area, as proposed, would be 32 square feet with a height of 22~ feet. <br />The applicant would require the variance to permit them to build on the right-of- <br />way as well as locate the sign 35 feet from the right-of-way at County Road C <br />where a 40 foot setback is normally required. <br /> <br />Discussion <br /> <br />Mr. Mastel asked if anyone could then build a sign at the same location if the <br />variance is given, should the current applicant move. Mr. Dahlgren indicated that <br />this would be possible, but that the Commission could also attach conditions to <br />the variance which would allow only them to build the sign. <br /> <br />Mr. Simons asked why the sign was located so close to the easterly lot line. <br /> <br />Mr. Dahlgren indicated that it was felt that the sign should be located as far <br />to the east as possible to allow for the piling of snow when the road is plowed, <br />as well as the possible widening of the road at some future date. <br /> <br />Recommendation <br /> <br />Mr. Rukavina moved and Mr. Mastel seconded, that the Planning Commission recommend <br />that Midwest Diesel request for variance to zoning ordinance at 1743 West County <br />Road C be approved provided that the applicant construct the sign as pr0posed in <br />the application. Roll Call, Ayes: Simons, Dressler, Mastel, Rukavina, Johnson. <br />Nays: None. <br /> <br />Planning File 1295 - Union Carbide Corporation request to amend zoning ordinance <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated that the applicant is requesting the zoning ordinance be <br />amended to include the maintenance and repair of gas cylinders; and the distri- <br />bution and sale, storage, processing and packaging of flammable and non-flammable <br />gas and liquids, and welding supplies; except gasoline and oil products; provided <br />
