<br />-2- <br /> <br />Mr. Matson indicated he had viewed the site and inquired as to whether the <br />maple tree at the northwest corner of the lot would be saved. <br /> <br />Mrs. Newman indicated that it would not be; and that, unfortunately, it would <br />not be able to be moved. <br /> <br />Mr. Johnson inquired as to why the original house was setback 20.9 feet <br />rather than the required 30 feet. <br /> <br />Mr. Dahlgren indicated that the house had been built before the 30 foot set- <br />back requirement had been incorporated into the ordinance. <br /> <br />Mr. Johnson noted that the legal rear yard did appear to be more like a side <br />yard and inquired as to the orientation of the house on Dellwood immediately <br />to the north of the applicant's home. <br /> <br />Mrs. Newman indicated that that home was also oriented toward Dellwood. <br /> <br />Recommendation <br /> <br />Mr. Matson moved and Mr. Rukavina seconded, that the John Newman request for <br />variance to floor area ratio and rear and side yard setbacks at 1990 Dellwood <br />be recommended for approval by the City Council. Roll Call, Ayes: Cushing, <br />Dressler, Mastel, Matson, Miller, Rukavina and Johnson. Nays: None. <br /> <br />Mr. Rukavina wished it to be noted that he felt the orientation of the house <br />on Dellwood was the main factor in recommendation of approval. <br /> <br />Mr. Mastel wished it to be noted that the solar panels on the top of the home <br />were of some concern. <br /> <br />Planning File 1315 - William Kugler request for variance to rear yard setback <br />at 1144 Dionne <br /> <br />Mr. Dahlgren indicated that the applicant proposed to construct four double <br />garages to serve his existing apartment structure. The buildings would be <br />constructed so as to have a two foot setback at the rear of the garage which <br />is contiguous to an alley serving the rear of the shopping center. He noted <br />that the Planning Commission and City Council had approved a similar variance <br />for a like structure some time in the past. He further indicated that the <br />existing parking capacity is 46 cars and that the addition of the garages would <br />increase the total parking capacity to 49 spaces, which was adequate for the <br />current building. <br /> <br />Mr. Dahlgren further indicated that the garages would be constructed of concrete <br />block with brick face on the front. He indicated that in meetings with the <br />applicant, he had discussed the possibility of placing bricks at the ends of <br />the garages as well, but that the applicant did not feel this was necessary. <br /> <br />Mr. Dahlgren also indicated that subsequent to preparation of the Planning <br />report, it had come to the staff's attention that there was a 7 foot private <br />easement on the south side of the property that had been granted for alley <br />way purposes to the owner of the shopping center to the south. He indicated <br />that Mr. Kugler had presented the staff with a document that seemed to indicate <br />that the easement had been released by the shopping center. He pointed out to <br />the Commission that since this was a private easement, it really was a private <br />matter between the two parties and that the Commission would consider the var- <br />iance on its merits. <br />
