The ordinance provides <br />that in a case of such developments contiguous to or across the street from lands <br />zoned R-l or R-2, such plans must be approved before a building permit can be <br />issued. He explained that the applicant may then appeal the reviewer's decision <br />to the City Council if the plans are not approved. He stated that much of what <br />the ordinance called for; i.e., the review of plans, was already being done by <br />the City staff and that what this ordinance would in effect do, is give some <br />teeth to any suggestions that the staff may make in the future. <br /> <br />Mr. Dahlgren said that most of the time developers were receptive to staff <br />suggestions, but that there was no way the staff could require developers to <br />incorporate staff suggestions. He further stated that this occurred primarily <br />when the development met normal zoning requirements, that is, it was being built <br />on properly zoned lands with the necessary setbacks, etc. In such a case the <br />plans would not come before the Planning Commission or Council but would normally <br />be simply reviewed and then a building permit be issued. With the ordinance, <br />all such plans would have to be reviewed and would be subject to approval by the <br />City Manager's designated representative. <br /> <br />Discussion <br /> <br />Mr. Kehr indicated that he would not be in favor of having a review board or <br />any level of government in addition to the Planning Commission and Council, <br />however, since Mr. Dahlgren would be the representative in this case, he did <br />feel confident that this type of plan would work and would be in favor of it. <br /> <br />Mr. Mastel stated that while he had every confidence in Mr. Dahlgren's ability <br />to perform the functions, he was concerned that the ordinance was designed with <br />Mr. Dahlgren in mind, and that should someone else replace Mr. Dahlgren, there <br />may not be the same level of expertise involved. <br /> <br />Mr. Matson indicated that he felt it was unfair to place such a great burden of <br />authority on anyone person and that it might place the businessman in a <br />position of coming before the Council with a plan that had, for all intents and <br />purposes, been disapproved and, therefore, the developer would have the dis- <br />advantage of being guilty before being heard by the Council. <br /> <br />Recommendation <br /> <br />t~r. Rukavina moved and Mrs. Dressler seconded, that the Planninq Commission <br />recommend adoption of the ordinance providing for review of plans for construction <br />in zones other than R-l and R-2 with the condition that it is specified that a <br />set of review criteria or a checklist be provided to the Manager's representative <br />to be used when reviewing plans.
