<br />Planning Commission Minutes <br />-3- <br /> <br />Matson indicated he does not see how the denial of the building can aid the <br />neighborhood. The approval of the building could enhance the site by providing <br />enclosed storage. <br /> <br />Berry indicated she was concerned with the lack of past conformance with the <br />conditions of the special use permit. She also felt a use with the intensity <br />of the Margolis operation should not be allowed in an R-l zone. She did <br />not want to encourage additional commercial-type use on the site. <br /> <br />Dressler indicated she felt the building may make it easier to expand the <br />operation. She felt the Margolis Company should just get rid of the <br />unsightliness already there. <br /> <br />Moeller indicated the neighborhood must be assisted with the problem that is <br />already there. The building may worsen the problem. <br /> <br />Rukavina indicated he felt the request for a storage building would be legitimate <br />under normal circumstances. But, the new building could be a further step toward <br />increased intensity of use on the site. Also, he was against tying approval to <br />compliance with the same set of conditions which have been unmet under the existing <br />special use permit. He will not support the request until compliance has been <br />obtained. <br /> <br />Recommendation <br /> <br />Berry Moved and Dressler Seconded that the Planning Commission recommend <br />denial of Margolis Brothers Company's request for special use permit at <br />295 Larpenteur. Roll Call, Ayes: Dressler, Berry, Moeller, and Rukavina. <br />Nays: Matson. <br /> <br />Planning File 1474 - Hoffman Corner Oil request for variance to side yard setback <br />at 3011 Rice. <br /> <br />Presentation <br /> <br />Mr. Dahlgren indicated the property in question has been occupied and utilized <br />as a gasoline service station for many years. The applicant proposes to add a <br />canopy over the two existing pump islands on the Rice Street side of the site. <br />The canopy as proposed will be 10 feet, 6 inches from the Rice Street right-of-way. <br />The ordinance requires a 30-foot setback. <br /> <br />Mr. Dahlgren indicated, based on the existing location of the principal building <br />and pump islands, it is obviously impractical to move all the structures back to <br />conform to the 30-foot setback requirement. Also, it appears that allowing the <br />variance will not have any apparent deleterious affect on the environs. <br /> <br />Mr. Dahlgren also indicated the pump islands are required to be set back 25 feet <br />from the right-of-way_ The existing islands appear to be set back approximately <br />22 feet. He indicated the Commission may wish to approve a variance to this <br />requirement so as to correct the nonconforming status of the pump islands. <br />
