Planning Commission Minutes

-7-

Planning File 1514 - Ed Flaherty request for variance to rear yard setback
and driveway setbacks at 1925 Lexington.

Presentation

Mr. Dahlgren indicated the applicant is requesting a two foot variance
to rear yard set back to enable the construction of an addition to the
existing service bay areas. The driveway setback variances are to bring
the existing driveways into conformance with City Code.

Mr. Dahlgren indicated the reason the variance is needed is that the legal
yard to the north is the rear yard although it serves as the side yard.

Mr. Dahlgren also indicated that 16.5 feet of additional right-of-way is
required along Lexington. Mr. Dahlgren suggested that 16 feet be requested
since existing curbing is at the 16 foot point.

Miles Lindberg, architect for the applicant, indicated that the applicant
objects to the dedication of the additional right-of-way.

Discussion

Matson asked about the dedication requirement.

Mr. Drown indicated it is the City's policy to require dedication 1n
variance situations.

Dressler suggested that if the City makes an exception here, it would
set a precedent.

Recommendation

Matson moved and Johnson seconded that the Planning Commission recommend
approval of Ed Flaherty's request for a 2 foot variance to rear yard set-
back at 1925 Lexington, with the following conditions:

1) That 16 feet of right-of-way be dedicated along Lexington.

2) That staff approves final drainage solutions.

3) That all plantings, flag poles, and curbingbe constructed or
relocated outside of the new right-of-way.

Roll Call, Ayes: Dressler, DeBenedet, Johnson, Matson, Moeller, and
Wiski.
