Janisch replied that he was not sure, but he is
quite confident that sewer and water is available in the area.

DeBenedet asked for clarification of the lakeshore setback, which
Janisch verified at thirty-six feet. Janisch also stated his
concern with respect to the proper elevation of the walkout area.

Johnson asked how old the homes were to
replied that they were built between 1965
pointed out that these homes were then built
ordinances were established.

the north. Hanson replied that they had done some soil borings.
Stokes also stated his concern that this area shows up on a
Federal Flood Plain Map, plus the curve on Victoria is quite
dangerous.

Doug Reynolds, speaking for a neighbor on the north, asked what
type of conditions the City would place on the development as a
result of poor soil. Janisch replied that the soil review would
be handled by the Building Inspector.

Maurice Merabella (across the street from the development) asked
whether other areas adjacent to this property would automatically
start developing. Janisch replied that would depend on any
proposals that would come forth for consideration. Janisch
stated he is aware that Reiling is considering some platting in
the area.

Johnson pointed out that the building would be about one story
higher than the other homes in the area, and it would have a peak
of roughly twenty-five feet.

Mary Ky10 (owner of the home adjacent to the development) stated
her concern about traffic in the area. Hanson stated that with
the house thirty feet back, the home is not in danger. He also
stated it is his understanding, based on some new laws, that if
the home owner can't develop, the City would have to compensate
the landowner.

Dahlgren replied that he was aware of the law that stated when
the new ordiance went into effect in 1959, that if an area met
seventy percent of the new standards, a development could proceed.
