He also inquired whether <br />there were easements in place for these water line. <br /> <br />Berry responded that was correct, and that she believed the <br />easements were required when the city acquired the water lines <br />from the private water company. <br /> <br />Janisch responded that city records show that the water lines are <br />at the location shown. DeBenedet asked if easements were in <br />place. Janisch responded that he could check. DeBenedet <br />indica ted that we could stipulate that easements for the water <br />line be provided as part of the lot division approval. <br /> <br />Goedeke inquired whether or not the lots were undersized. <br />Dahlgren responded that new lots are required to be 85 ft. wide <br />and have ll000 sq. ft. City policy is that where there is in <br />fill development, policy is to approve divisions which are <br />consistent with the area. The question in this case is whether <br />to have 2 smaller lots, or one large lot. The lot sizes being <br />proposed are common to other areas, and the new house would <br />conform to the larger 10 ft. set back requirements. <br /> <br />Betty McClain, 2847 Oxford Street, indicated her support for the <br />project. <br /> <br />DeBenedet moved, Goedeke seconded that Norm Vinnes request for <br />division of platted lot at 28ll North Oxford Street be <br />recommended for approval with the following condition: <br /> <br />1. That any necessary easements be granted to the City, if <br />Staff determines that they do not currently exist. <br /> <br />Nays: <br /> <br />Moeller, DeBenedet, Berry, Goedeke, <br />Maschka, Stokes <br />None <br /> <br />Roll Call; <br /> <br />Ayes: <br /> <br />Other Business: <br /> <br />Stokes inquired whether a post office could be allowed in a B-1 <br />zoning district. Dahlgren responded that the city's ordinance <br />could be amended to allow a post office in a B-I zone by special <br />use permit. The Planning Commission could recommend such an <br />action to the City Council. Waldron indicated that the City <br />Council would have to refer the matter back to the Planning <br />Commission and then the Planning Commission could recommend <br />Council approval of the amendment.
