Michaels presented a petition with the names of five people who own outlots in the area and which support his proposal. Michaels stated that he bought the property to pursue the development of Sextant Avenue and intended to sell the house on County Road B-2. Steve Owen, 601 W. County Road B-2, expressed his opposition to the proposal as well as to the construction of the extension of Sextant Avenue. Johnson asked if Mr. Owen was aware of the petition that Michaels had submitted. Owen responded that he was not aware. Michaels stated that Mr. Owen was not contacted because there would be no monetary impact on him for the construction of the extension of Sextant Avenue. Johnson pointed out that the effect on Mr. Owen addi tional houses behind him. Owen indicated he was that and he opposes this application. would aware be of Richard McGill, 574 Transit Avenue, indicated he was in favor of the proposal. Mr. Moser, 2424 N. Dale Street, stated he was in favor of the proposal. Johnson closed the public hearing. DeBenedet moved and Berry seconded to recommend approval of the proposed lot division with the following conditions: 1. That the outlot be identified as not buildable without public street frontage and access. 2. That the temporary 10 foot easement be included across parcel B to allow access to outlot A for maintenance. Stokes questioned whether the Planning Commission had the right to require the easement. Dahlgren responded that Michaels has proposed the easement, and that the commission is recognizing and accepting the easement proposal.
