ROSEVILLE PLANNING COMMISSION

page#18

Wednesday, October 12, 1988

Jopke summarized the history of City actions concerning this
site.

Rekuski summarized the history of his actions on this site in
remodeling his existing dwelling and attempting to deal with the
problems his neighbor Mr. Larson had.

Johnson asked what the status of Rice Creek Water Management
review was. Mr. Rekuski replied he had met with them and he
would know more in the next day.

Moeller inquired what the value of the permits was. Jopke
replied that the value listed on the last permit was $43,000.
Moeller questioned the construction process and stated that the
applicant should know the process because he's a contractor.

Rekuski replied that the permits included all of the work except
for the addition of brick to the structure.

Berry asked if a permit had ever been issued for the new house.
Jopke responded that no permit had been issued for a new house.

Johnson asked if a shoreline permit had been issued. Rekuski
replied that the setback from the lake is no different than it
was before.

DeBenedet questioned how the wall got constructed 3 ft. from the
property line when it was supposed to be 5 ft. Rekuski answered
that there was confusion regarding the variance issued and the
architect assumed that the variance issued for the garage to be 3
ft., applied to the whole dwelling. Rekuski added that he
offered to move the wall back in April but Mr. Larson said that
was not what he wanted so he continued and finished the house at
its existing location.

Berry asked how many times the site had been inspected.
reviewed the inspections that had been completed.

Jopke

Vaughn Larson, 1211 Josephine Avenue, stated that he did not
agree with the events as described by Mr. Rekuski. Larson stated
that he opposed the variance and provided the Planning commission
with a letter which outlined his concerns. Larson said that in
April he did not know his legal rights and that Mr. Rekuski has
not dealt with him and not done what he was supposed to do.

DeBenedet asked if the 8 items as discussed in April were
complied with if Mr. Larson would agree to the variance. Larson
replied that he would not and in the past he thought that was his
only option. Larson stated he wanted the property brought into
