ROSEVILLE PLANNING COMMISSION

page# 7

Wednesday, December 7, 1988

has to be part of this approval. Dahlgren responded that
easements are required in the subdivision ordinance and are a
normal part of the platting process.

DeBenedet asked
sanitary sewer.

for clarification about the
Keel pointed out the location.

location

of

the

Johnson testified that the easements have been missed in other
areas of the city also.

Dahlgren pointed out to the applicant that the easement does not
affect the developability of the lot because its within a
required rear yard setback area.

Hanson asked if the easement was required on the lot to the
north. Keel replied that he was not sure.

stokes stated that the sewer line served this particular property
and without the easement, the city could not fix it if there was
a problem.

Berry asked if the easement was a problem because this was the
first time the applicant has heard about it. Johnson replied,
yes.

Keel testified that the staff had just discovered the problem
because we were reviewing as builts which were kept by
engineering consultants and not in the City files.

Moeller inquired if the Commission should table this matter.
Berry replied that the commission could recommend approval with
the condition that the easement be provided and that the
applicant could review it and withdraw the request if it was a
problem.

Johnson closed the public hearing.

DeBenedet moved, Goedeke seconded to recommend approval of the
lot division with the condition that a 20 foot sanitary sewer
easement be provided along the east edge of parcel B as required
by staff.

Roll Call:

Ayes:

stokes, Moeller, DeBenedet, Berry,
Goedeke, Johnson

Nays:

None
