Keel <br />pointed out that the sidewalk would be built on the west side of <br />the road and that the developer will provide sidewalk on <br />Larpenteur. <br /> <br />DeBenedet asked if the normal policy would be to require sidewalk <br />on both sides. Keel replied that city staff did not discuss cash <br />contribution on the east side of the road and that the policy is <br />unclear at what point new requirements kick in. DeBenedet <br />pointed out that the 50% rule appeared to be exceeded in this <br />case. <br /> <br />Berry moved, Stokes seconded to recommend approval of a special <br />use permit for site plan approval at 1201 Larpenteur with the <br />following conditions: <br /> <br />1. That there be stucco finish all around the structure. <br />2. That the development of the facility be as submitted on the <br />plans dated 8-22-89. <br />3. That there be dedication of additional right-of-way for <br />sidewalk purposes along the south side of the site with <br />construction of a 5 foot sidewalk. <br />4. That Engineering landscape details be subject to final staff <br />review. <br />5. That staff review the joint access agreement to determine if <br />the green strip issue can be resolved. <br />6. That the developer provide a cash contribution in lieu of <br />sidewalk on Fernwood Avenue. <br />7. That staff review and approve the design of the retaining <br />wall to the north. <br /> <br />Maschka indicated concern about the sidewalk requirement and <br />requiring the building to be stuccoed. <br /> <br />wietecki said he has the same concerns and pointed out if the <br />City has such rigid requirements, than the Planning Commission is <br />not necessary. wietecki indicated that the applicant has made a <br />good effort and that the City could push the applicant to a point <br />where nothing would happen on the site. <br /> <br />Johnson stated she supports the requirement for all stucco <br />because it is what the apartments look at. <br />
