<br />ROSEVILLE PLANNING COMMISSION <br /> <br />Page:f/: 5 <br /> <br />Wednesday, February 7, 1990 <br /> <br />Dahlgren stated that in the past, the policy has been to approve <br />the lot divisions if they are in scale with surrounding lots. <br /> <br />DeBenedet suggested that the Commission amend the motion to state <br />that neither of the lots be less than 11,000 sq. feet. He <br />commented that the rights of the surrounding neighbors are <br />protected by the zoning ordinance. He also stated that the staff <br />found no reason to deny the request and stated that he favors <br />this lot division. <br /> <br />wietecki commented that it was not clear if they were taking away <br />the right of privacy of the surrounding neighbors. <br /> <br />Dahlgren stated that lots having double frontage have a great <br />potential for division. He also stated that the lots would be <br />135 feet long with substantial room behind the house. <br /> <br />wietecki stated that there is the potential of limiting rights <br />and the neighbors use of their properties. <br /> <br />DeBenedet questioned how to balance those rights. DeBenedet <br />stated that municipalities have to obey their own laws and rely <br />on the zoning code. <br /> <br />Johnson added that they must follow the ordinances of the city. <br /> <br />wietecki questioned whether the City should be asking the <br />developer to pay for a portion of street costs. Keel outlined <br />the cities assessment policy as it relates to double fronting <br />lots. <br /> <br />Berry stated that this is what the City has been asking for in <br />terms of new lots. <br /> <br />Berry moved and DeBenedet seconded to recommend approval of <br />Thomas and Mary Short's request for division of a platted lot at <br />990 W. County Road B with the following conditions: <br /> <br />1. That dedication of right-of-way occur as proposed for County <br />Road B and Burke Avenue (total of 40 feet) prior to filing <br />of deed. <br /> <br />2. That payment of required additional assessments be made. <br />3. That staff approve drainage and utilities plans. <br /> <br />4.
