Jopke stated that a shed was not much <br />different than an ice cooler. DeBenedet stated that coolers are <br />not a structure. <br /> <br />Hasek stated that this could be approved based on it being open <br />storage with a clarification that another approval is needed for <br />a shed building permit. <br /> <br />MOTION <br /> <br />Berry moved and DeBenedet seconded the motion to recommend the <br />special use permit for outside storage and merchandising with the <br />following conditions: <br /> <br />1. That any new structure has to come back for city approval. <br />2. That merchandise carts only be displayed during business <br />hours. <br />3. This <br />variance is being requested for the Rosewood Estates project on <br />victoria street. <br /> <br />Presentation <br /> <br />Hasek summarized the site location and why a variance was needed. <br />Hasek stated that the encroachment was not significant. Hasek <br />said that the building was 3.6 feet too close to the shoreline <br />as measured from the ordinary high water mark. <br /> <br />Roberts questioned whether they were defining wetlands as <br />highwater. Hasek stated that they were but that what was called <br />for in the ordinance was the ordinary high water mark. <br /> <br />Jopke stated that the ordinary highwater mark was where the <br />vegetation changes from wetland vegetation to dryland vegetation <br />and that structures must a minimum of 75 feet from this mark. <br />
