Maynard stated that it might be <br />more. Maynard commented that they want a variance to allow the <br />building to stand as is and that he is willing to have staff go <br />out with the surveyor to determine exactly how big a variance is <br />necessary. <br /> <br />wietecki stated that certain counties have required the buildings <br />be demolished when they encroach in setback areas. It is <br />important to find out exactly what the encroachment is. <br /> <br />Johnson stated that she was disturbed that this encroachment was <br />looked upon as insignificant. Johnson pointed out that the <br />City's ordinance was one of the first in the state and is <br />important to the City. <br /> <br />Berry stated the trouble might have occurred because 1988 was a <br />drought year and shoreline has moved. Berry testified that it is <br />important to establish how far the encroachment is. Berry added <br />that it was the responsibility of the staff to ensure that these <br />lines are in accordance. <br /> <br />Gary Wood of 3060 Owasso stated that he concerned about the <br />repeated violations. He stated that at some point the city has <br />to draw the line. <br /> <br />Johnson stated that the city has taken a stance. She stated that <br />all are concerned about this violation. <br /> <br />Wood stated that if demolishing the building is necessary, so be <br />it. <br /> <br />MOTION <br /> <br />Stokes moved to and DeBenedet seconded to table this matter until <br />the August 1st, 1990 meeting so that the applicant can determine <br />exactly how the encroachment occurred and exactly how much the <br />encroachment is. <br /> <br />Roll Call: <br /> <br />Ayes: <br /> <br />Berry, DeBenedet, Johnson, Roberts, <br />stokes, Wietecki <br /> <br />Nayes: <br /> <br />None <br />
