<br />ROSEVILLE PLANNING COMMISSION <br /> <br />Paget 17 <br /> <br />April 10, 1991 <br /> <br />Roll Call: <br /> <br />Ayes: <br /> <br />stokes, Goedeke, Roberts, Wietecki, <br />Harms, Thomas, DeBenedet <br /> <br />Nayes: <br /> <br />None <br /> <br />Shoreline Ordinance <br /> <br />Presentation <br /> <br />Shardlow discussed the shoreline ordinance procedures and <br />proposed changes. Shardlow pointed out that there is no need to <br />go through a separate process, that compliance with the shoreline <br />ordinance provisions could be handled through a normal permit <br />review process. Shardlow also outlined proposed changes in the <br />shoreline variance process to require Planning Commission and <br />City Council review. <br /> <br />wietecki stated that shoreline variances should be reviewed by <br />the Planning commission. <br /> <br />Jopke indicated his concern that this process could be unduly <br />burdensome in the situation where a property owner wishes to make <br />minor improvements to a existing non-conforming dwelling. <br /> <br />wietecki stated that the City could define areas of concern to <br />eliminate that situation. <br /> <br />Roberts asked if other governmental bodies need to be involved in <br />the shoreline process. Shardlow stated that the City has adopted <br />a shoreline ordinance as required by the state and it is up to <br />the City to administer it. <br /> <br />Roberts stated that it is important to put teeth into the <br />ordinance to protect lakes. <br /> <br />Shardlow pointed out that the shoreline ordinance can't render a <br />lot unbuildable which is otherwise buildable. Shardlow added <br />that there was a Roseville case which reconfirmed this. <br /> <br />DeBenedet stated that the reason the state required shoreline <br />ordinances is that lakes are not private matters but city wide <br />and regional matters. DeBenedet added his support for review of <br />variances by the Planning commission and City Council. <br /> <br />MOTION <br /> <br />wietecki moved and Roberts seconded that staff and the City <br />Attorney prepare ordinance language to eliminate the requirement <br />for a separate shoreline permit and to modify the shoreline <br />
