<br />ROSEVILLE PLANNING COMMISSION <br />September 8, 1993 <br /> <br />Page# 10 <br /> <br />Roll Call: <br /> <br />Ayes: Rengel, Thomas, Harms, Wall, Wietecki <br /> <br />Nayes: <br /> <br />Roberts <br /> <br />P'anning Files 2614 <br /> <br />Chuck Kadrie request for a variance to the shoreland setback ordinance at 1281 <br />Josephine Road. <br /> <br />Presentation <br /> <br />FaIk provided the history of the project and highlighted the existing issues relating to <br />the variance request. <br /> <br />Dennis Smith, Attorney for Chuck Kadrie, indicated that the permit was originally <br />approved for the kitchen expansion and the deck is a substandard use. Section <br />18.08.10 states "appurtenance" is a deck attached to the house and is substandard. <br /> <br />Issues discussed included how pre-existing conditions are to be addressed, the <br />expansion as it now exists, previously granted building permits, the fact that the current <br />construction has no building pennit, one year time restrictions for building permits, City <br />Council interpretations of the current code, how other communities interpret the <br />shoreland ordinance, the purpose of the shoreland ordinance, how the ordinance defines <br />the high water mark, and if the City Attorney is involved in this issue. <br /> <br />Citizens <br /> <br />Maribelle Cushmann, 1265 Josephine Road, explained that she had distributed a letter <br />to the Planning Commission regarding this variance and expressed her desire that the <br />Commission make a decision on this matter. <br /> <br />Wietecki closed the public hearing. <br /> <br />MOTION <br /> <br />Harms moved and Wietecki seconded a motion to recommend approval of a variance <br />for the kitchen expansion and to recommend denial of a variance for a deck closer than <br />
