<br />CITY OF ROSEVILLE PLANNING COMMISSION MEETING <br />WEDNESDAY, MARCH 8, 1995 <br /> <br />Chairman Wietecki closed the public hearing. There were no public questions or <br />comments. <br /> <br />Chairman Wietecki questioned who was served by this sanitary sewer line. <br /> <br />Member Wall asked if it was appropriate for the Planning Commission to act on this <br />matter with a City Attorney review still going on and also questioned whether the <br />vacation is even necessary. <br /> <br />Chairman Wietecki stated that the vacation is needed. <br /> <br />Member Wall asked whether the issuance of a building permit, in fact, acted as a vacation <br />of the easement. Mike Falk responded that the building permit would not act as a <br />vacation and that there would be no clear title without the City officially vacating the <br />easement. <br /> <br />Motion: <br /> <br />Member Wall moved and Member Sandstrom seconded to recommend <br />approval of Arthur Mueller's request for vacation of easement at 2241 <br />Ferris Lane subject to City legal counsel approving an agreement holding <br />the City harmless to potential damage to the structure and extraordinary <br />expense if the City has to excavate the sanitary sewer line. <br /> <br />Roll Call: <br /> <br />Ayes: <br />Nays: <br /> <br />Harms, Rengel, Sandstrom, Wall, Wietecki <br />None <br /> <br />6. <br /> <br />(t) <br /> <br />Planning File 2732: Super America request for a special use permit to construct <br />a station/store with a car wash at 2380 W. County Road D. <br /> <br />Chairman Wietecki opened the public hearing. <br /> <br />Mike Falk described the proposed new Super America station/store to be constructed on <br />the site ofthe former Chester's Restaurant. Mr. Falk pointed out that the station/store is <br />permitted in the B-2 zoning district by special use permit and that the station/store is <br />consistent with the City's Comprehensive Plan designation of business. Mr. Falk <br />described the location of the various elements of the proposal, including the store <br />building, gas pumps, car wash, and trash enclosure. Mr. Falk pointed out that the <br />proposal would meet the City's design standards, would result in less impervious surface <br />on the site, and that the proposal would meet City parking requirements. All building and <br />parking setbacks would be met and there would be no impact on adjacent roadways. Mr. <br /> <br />10 <br />
