<br />Planning Commission Minutes <br />August 9, 1995 <br /> <br />approval of the Western Auto request for commercial PUD consisting of <br />approximately a 12,000 sq. ft. retail auto parts facility and rezoning from <br />Bland B2 to a PUD on 2.88 acres located in the northwest quadrant of <br />Snelling and Oakcrest A venue, provided: the building materials meet the <br />design standards; the parking spaces are removed adjacent to the south <br />property line; the 15 foot parking setback is restored; the lighting on the <br />building is corrected to reduce glare; the landscape materials are upgraded <br />as per the staff report; the engineering recommendations are incorporated <br />into the final site plan; and the activities within the project area as <br />proposed by Western Auto conform to the description of permitted uses <br />within the PUD. (Any deviation from PUD permitted uses would require <br />an amendment to the PUD permit). <br /> <br />ROLL CALL: <br /> <br />Ayes: <br />Nayes: <br /> <br />Wietecki, Harms, Sandstrom, Rhody, Cunningham <br />None <br /> <br />6. <br /> <br />(b) <br /> <br />An Ordinance Amending Title 10 zoning, of the City Code, relating to zoning <br />within Chapters 1005 and 106, by providing Bingo Halls as a Conditional <br />Use in certain districts. <br /> <br />Chairman Keith Wietecki opened the public hearing and requested Michael Falk to <br />provide a description of the request. Mr. Falk explained that, at the July 12, 1995, <br />Planning Commission Meeting, the Commission discussed the Ordinance that would <br />expand zoning districts where bingo halls were permitted by a Conditional Use Permit to <br />include B2, B3, and shopping center. He explained that this Ordinance would be <br />necessary to allow the re-Iocation ofthe existing bingo hall from the Knights of <br />Columbus Hall on Snelling A venue to the Hamline Shopping Center on Hamline <br />A venue. The Commission continued the hearing on this issue until the August 9th <br />meeting, requesting additional information and discussion. The Commission was <br />concerned about additional openings created in the community for bingo halls. The city <br />staff discussed this matter with the city attorney's office. The attorney indicated that he <br />felt there was sufficient strength in the State Statute and city code licensing requirements <br />to effectively limit the number of bingo halls in the city. The city is authorized to <br />prohibit them completely if it so desires. The city attorney also stated that a PUD could <br />be required, but that administration would be complex and cumbersome. He <br />recommended adopting the original proposed ordinance. <br /> <br />Member Harms asked if an ordinance could allow one bingo license at a time. (The city <br />code currently does allow only one license at a time.) <br /> <br />6 <br />
