<br />Planning Commission Minutes <br />November 8, 1995 <br /> <br />Lee Smith, 473 Minnesota, stated that the proposed fence around the entire property <br />would reduce property value. He has had no problem with the Temple. The parking on <br />the street on Sunday's has been no problem. He likes the openness of the site. <br /> <br />Jim Westby, 480 Lovell Avenue, stated he had no concern with the parking on Sundays <br />and no problem with the children using the area east ofthe Temple. In fact, the Westby <br />property has been used for parking and volleyball. He objected to the fence. <br /> <br />Temple representatives stated that they appreciate the help ofthe neighborhood. They <br />noted that Mr. Westby had invited parking and play area to take place on his property. <br />The Temple Association will build portions of the addition to discourage the children <br />from going to the Homeowner's Association pond area as they are also concerned about <br />the safety of their children. <br /> <br />There were no further comments. Chairman Keith Wietecki closed the public hearing. <br /> <br />Member Rhody stated that the Temple gave up open space to the west when the Villa <br />Association construction occurred. The Temple supported the townhomes as they are <br />currently designed. The Temple has been improved since the Buddhist Association took <br />over the site. He expressed concern that there was water in the pond and recommended <br />that the Townhome Association build their own fence. <br /> <br />Chairman Wietecki asked if the property owners have the right to put a fence or building <br />on the easement. (No) He asked what the unusual hardship or practical difficulty would <br />be with the rear yard setback. Michael Falk responded that the configuration of the <br />courtyard and building make it important for meditation. There is no other location on <br />the site for this courtyard. <br /> <br />MOTION: Member Thein moved, seconded by Member Harms, to recommend <br />approval of the 20 foot sideyard and 15 foot rear yard variances requested by Khuyen <br />Nguyen/Vietnamese Buddhist Association, located at 475 Minnesota Avenue with the <br />following conditions: <br /> <br />a. The west side of the property be landscaped as approved by the staff. <br />b. The outdoor materials be cleaned up. <br />c.
