<br />Planning Commission Minutes <br />May 8, 1996 <br /> <br />at the corner could be used as a walk-in store, more convenient and consistent with the <br />neighborhood design. <br /> <br />Member Wilke stated that the new proposal submitted by Kath is a much better proposal <br />providing a better buffer to the east. <br /> <br />Member Thein stated that Kath has made an investment in the community, and made <br />many compromises on the site. He expressed concern about the ability to replace dead <br />trees and expressed concern about guarantees in five years. He also expressed concern <br />about the need to raise the level of comfort with the neighbors. <br /> <br />Member Harms asked for clarification regarding the changes in the comprehensive plan <br />and the use of scenic easement along the buffer land. <br /> <br />Member Rhody stated he would prefer to have the building at the corner to create more of <br />an urban design, and to eliminate the amount of asphalt and parking lot visible from <br />Lexington Avenue. <br /> <br />Member Thein stated that he wanted to approve the station in a manner that would make <br />it successful. The worse problem would be having a station begin operation and fail. <br /> <br />MOTION: Member Harms moved, seconded by Member Cunningham, to recommend <br />amending the Comprehensive Plan from residential to business for the northeast parcel of <br />the project, subject to Metropolitan Council approval as per the staff draft resolution. The <br />motion carried 6-0. <br /> <br />Roll Call: <br /> <br />Ayes: <br />Nayes: <br /> <br />Thein, Rhody, Wilke, Cunningham, Harms, Wietecki <br />None <br /> <br />MOTION: Member Harms moved, seconded by Member Wilke, to recommend <br />approval of the conditional use permit, the rezoning, the preliminary plat, and the final <br />plat with staff conditions 1-18 and additional issues to include design details and <br />materials similar to the building placed on the canopy and numbers 19-24 as follows: <br /> <br />19) Street trees should be reviewed by the city forester. <br />20) All development shall occur within 19 months or the zoning and conditional use <br />permits revert to previous uses. <br />21) All car wash doors shall remain shut until the blowers for the dryer are off. <br />22) A fence shall be placed adjacent to the gas and convenience building on the car <br />wash driveway and not at the east property line of the project. <br />23) The site shall be irrigated, providing sprinkler systems for trees, shrubs and grass. <br />24) Violation of the terms of the conditional use permit shall be considered a violation <br />ofthe city code and may include fines and/or revocation of the permit. <br /> <br />9 <br />
