<br />Planning Commission Meeting Minutes <br />November 13, 1996 <br /> <br />6. PUBLIC HEARINGS: <br /> <br />6(a) Planning File 2861: Twin City Mack Truck request for a vacation of the <br />north half of County Road C-2 right-of-way, lying east of Long Lake Road <br />and west of 135W. <br /> <br />Chairperson Keith Wietecki opened the public hearing and requested Mike Falk <br />to present a summary of his written report dated 11-13-96. <br /> <br />Falk described the right-of-way vacation request by Mack Truck, noting that <br />Mack Truck wished to vacate the north half of the right-of-way. He noted that in <br />the past, an overpass for County Road C-2 was planned. That plan has now <br />been abandoned. <br /> <br />Mack Truck proposed improvements to the site include new landscaping, <br />parking, curbs, and site improvements. Falk listed the engineering concerns <br />including: <br /> <br />1. There are back assessments in the amount of $2,032.54 which must be <br />paid. <br /> <br />2. The County Road C-2 right-of-way currently serves as a parking area for <br />the employees of the adjacent businesses. As part of the right-of-way <br />vacation, Mack Sales and Service is required to close off the entrance to <br />the County Road C-2 right-of-way from Long Lake Road. Even though <br />the current parking on the County Road C-2 right-of-way is not allowed by <br />City Code, the closure impacts other businesses because they must park <br />on their own sites. <br /> <br />3. The boundary survey should be corrected to reflect the actual right-of-way <br />that remains. There was a portion of the right-of-way vacated by MnDOT <br />prior to this application. <br /> <br />4. For the proposed ponding area, an emergency overflow must be provided <br />to protect the adjacent property from flooding. <br /> <br />5. A 20' drainage and utility easement is needed. <br /> <br />2 <br />
