would be closer to the OHWL than the rest of the dwelling and that
the addition would substantially increase the impervious surface
coverage of the lot. She indicated that the DNR would support a
variance to construct the addition in line with the existing
dwelling, which would not encroach further into the required
setback from the OHWL of Lake Josephine. She also indicated
that the DNR would support a variance from the impervious lot
coverage requirement in order to construct the proposed addition
in line with the existing dwelling.
6.The proposed variance is not in harmony with the general purpose
and intent of the City’s Comprehensive Plan and Title 10 of the City
Code (Zoning); however, a variance to reduce the setback from the
OHWL to 30' in order to construct an addition in line with the
existing dwelling and to increase the impervious surfact lot
coverage to 63% would be in harmony with the general purpose
and intent of the City’s Comprehensive Plan and Title 10 of the City
Code (Zoning).
7.The proposed variance, if granted, will adversely affect the public
health, safety, or general welfare. The variance as modified, if
granted, will not adversely affect the public health, safety, or
general welfare.
The applicant was not present.
Motion carried 6-0.
Chairperson Wietecki opened the hearing and asked if there was anyone present
wishing to speak.
Paul Sands, 1747 N. Dale, lives on the north side of the property, requested the
variance be denied because:
1) 40-50 feet of fill which is not buildable
2) a water main runs through lot
3) sewer line must come from Alta Vista.
Sands stated the lot was not buildable. If compaction must be done, it would be within
15' of his foundation.
Chairperson Wietecki closed the hearing.
6(c)Planning File 2924.
Request for a Variance, by Vision World, to allow
placement of a second pylon or ground sign in B-4 Zoning District,
located at 2277 West Highway 36.
3
