screen from the adjacent high density residential uses to the west. <br />4.The redevelopment of the property as proposed will not have an adverse <br />impact on the market value of contiguous properties. <br />5.The redevelopment of the property as proposed will not have an adverse <br />impact on the general public health, safety and welfare. <br />6.The redevelopment of the property as proposed is consistent with the City <br />? <br />of Rosevilles Comprehensive Plan and Title 10 of the City Code <br />? <br />(Zoning), including the Citys design standards. <br />Recommendation: <br />Based on the findings outlined above, the Planning Commission recommends <br />approval of the request for a conditional use permit to allow the construction and <br />? <br />operation of a new take-out/self-service restaurant (Arbys/Sbarro) at 2105 <br />Snelling Avenue North, with the following conditions: <br />1.The site must be developed in accordance with the final plans (site plan <br />dated 01/07/98, construction plan dated 12/30/97, demolition plan dated <br />12/30/97, directional signage plan dated 12/30/97, building elevation and <br />materials plan dated 12/15/97, and landscape plan dated 01/07/98) <br />submitted and approved in conjunction with the request for a conditional <br />use permit. Minor variations from the approved plans may be approved <br />? <br />by the Citys Development Review Committee, under the direction of the <br />Community Development Director; however, any substantial departures <br />from the approved plans will require an amendment to the conditional use <br />permit. <br />2.Prior to a building permit being issued for the project, the applicant must <br />provide the City with written permission/approvals that off-street parking <br />for employees and construction workers will be provided on another site. <br />Such documentation may include parking agreements with adjacent <br />property owners. <br />3.Final grading and utility plans must be reviewed and approved by the <br />Public Works Director. An erosion control plan must be developed and <br />erosion control must be in place prior to grading of the site. Since the site <br />is less than 2.5 acres in size, it is unlikely that on-site ponding will be <br />required by the Rice Creek Watershed District; however, the applicant will <br />need to contact the District for permit requirements. <br />4.All site lighting, including lighting for the parking area and exterior <br />building lighting, must comply with the requirements of Section 1010.12 of <br />8 <br />
