A lighting plan must be submitted to and approved by the <br />City in conjunction with application for a building permit. <br />5.A detached trash enclosure will be allowed, provided it is constructed of <br />the same or similar masonry materials as the principal structure and <br />roofed in accordance with Section 1010.14 of the City Code. <br />? <br />6.The existing non-conforming pylon sign for Arbys will be allowed to <br />remain, with the face of the reader board portion being replaced to allow <br />pylon signage for Sbarro. All other signage for the project must comply <br />with the requirements of Section 1009 of the City Code, including the size <br />and location of wall signs and directional signs. <br />7.The sidewalk along the front of the property shall be improved and/or <br />replaced if required by the City in conjunction with site development. <br />Pedestrian access must be provided from this sidewalk to the front door of <br />the building via a paved pedestrian surface. <br />8.Prior to a building permit being issued for redevelopment of the site, the <br />applicant shall post a landscape bond, letter of credit, or other security <br />acceptable to the City, in an amount equal to 150% of the cost of site <br />landscaping, street tree planting, and site restoration. The specific <br />amount of this security shall be determined by the Community <br />Development Director following completion of all site construction plans. <br />9.The water and sewer lines for the existing building must be disconnected <br />upon completion of the new building and demolition of the existing <br />building. <br />10.The applicant shall record the approved conditional use permit with the <br />Ramsey County Recorder prior to the issuance of any building permit or <br />within sixty days of approval, whichever is less (Section 1013.01G of the <br />City Code). <br />11.The conditional use permit shall expire within six months of the date of <br />City Council approval if a building permit is not obtained for the approved <br />development (Section 1013.03 of the City Code). <br />Member Mulder stated that he could accept the existing freestanding sign.(#6) <br />Chair Wietecki stated the City is providing three conditions not normally <br />discussed: signage, circulation and trash containers. <br />Member Rhody asked for clarification of signage and motion.
