1.The site must be developed in accordance with the final plans (site plan, <br />grading/erosion control plan, utility plan, landscape plan, building <br />elevations,and project narrative) submitted and approved in conjunction <br />with the request for a conditional use permit. Minor variations from the <br />approved plans may be approved by the City’s Development Review <br />Committee, under the direction of the Community Development Director; <br />however, any substantial departures from the approved site plan will <br />require an amendment to the conditional use permit. The conifers along <br />the east property line must be preserved if possible.The applicant shall <br />work with City staff on improvements to the landscape plan (screening of <br />parking area, additional shrubs on the west side of the storm water pond, <br />placement of conifers on the north side of the building, and additional <br />shrubs on the north side of the building), the location of the trash <br />enclosure (attached to building if possible), and the hours of operation <br />(conflict between hours identified in project narrative and hours stated <br />during the public hearing). <br />2.The exterior elevations of the building must be modified to bring the <br />building into compliance with the City’s design standards. The exterior <br />materials need to be upgraded to meet commonly used retail store <br />materials (brick, trim block, and stucco - all to be color impregnated), as <br />approved by the City’s Community Development Director. <br />3.Final grading and utility plans must be reviewed and approved by the <br />Public Works Director prior to the issuance of any building permits. A <br />Rice Creek Watershed permit must be obtained prior to the issuance of <br />any building permits. <br />4.Sidewalks need to be extended across the east frontage of this property <br />and the Knights of Columbus property from the bike path south to <br />Oakcrest, at the applicant’s expense, in conjunction with site development <br />as required by Section 1012.07 of the City Code. Pedestrian access must <br />also be provided from this sidewalk to the front door of the NTB building <br />via a paved pedestrian surface. <br />5.All site lighting, including lighting for the parking area and exterior <br />building lighting, must be downcast, shielded, and comply with the <br />requirements of Section 1010.12 of the City Code. <br />6.All signage for the project must comply with the requirements of Section <br />1009 of the City Code, including the size and location of wall signs, pylon <br />or monument sign, and directional signs. If a pylon or monument sign is <br />used, it must adhere to the materials palette of the building. <br />7.Air conditioning must be available to the entire building in order to allow <br />6 <br />
