There being no further questions or comments, Chair Harms closed the hearing. <br />Motion: <br /> Member Mulder moved, Member Rhody seconded, to recommend approval <br />? <br />of Suzanne Wilds request for a variance to increase the width of a commercial <br />curb cut from 36 feet to 55 feet for the purpose of retaining off-street parking spaces <br />at 2960 Snelling Avenue North, based on the following findings: <br />1.Section 703.04 (B)(1) limits the width of a non-residential curb cut to 36 feet <br />in non-residential areas. The property has historically had unlimited access <br />from the service road and six parking spaces at the front of the building. If <br />the curb cut is installed at a width of 36 feet, two of these parking spaces will <br />be lost. <br />2.The substandard width and size of the parcel creates a physical hardship for <br />the applicant. The substandard size of the parcel also presents a practical <br />difficulty in providing adequate off-street parking on the site. <br />3.The proposed variance is in harmony with the general purpose and intent of <br />? <br />theCitys Comprehensive Plan and Title 10 of the City Code (Zoning). The <br />proposed increase in curb cut width will allow the continued use of the siz <br />parking spaces and alleviate parking problems in the area. <br />4.The proposed variance, if granted, will not adversely affect the public health, <br />safety or general welfare. Peter Kelsey and Greta Friedemann are requesting <br />variances to reduce the setback from the ordinary high water level of Walsh <br />Lake to 37.5' and to reduce the front yard setback to 20' for the purpose of <br />establishing a building pad on a new lot at 1935 Lake Street. <br />Chair Harms opened the hearing and requested Dennis Welsch present a <br />summary, based on written reports dated July 8, 1998, of the request for variances <br />at 1935 Lake Street, indicating a shoreland variance of 9' and a front yard variance <br />of 10' was being requested. He advised the building pad being requested was in <br />line with other homes; discussed the hardship and recommended approval with <br />DNRcomments (which is a 60-day time period). <br />Applicant, Peter Kelsey, 401 South First Street, #1010, Minneapolis, advised he <br />would build a walk-out style home on the lot. <br />14 <br />
