The dining area closes at 10:00 p.m.; only the drive-through is open from 10:00 p.m. to 2:00 p.m..

Peter Anderson, 1105 California Avenue West, noted that he was present at the initial approval and continues to
oppose the expanded hours, particularly in the weeknights. Thomas Paschke explained pass-by traffic is existing
traffic. Mr. Anderson said the increased traffic would be "bar traffic". His block is elderly and young children. Mr.
Anderson said his property has become a trash dumping ground from Taco Bell, which will increase with expanded
hours. He suggested reduced hours of operation on weeknights but longer hours on weekends. He had no concern
regarding the proposed signage on the building.

Member Duncan said he was concerned with the number of objections (few) and the block club support or negative
comments. How many residents are opposed?

Member Cunningham asked Mr. Anderson if additional traffic was being added to California Avenue by Taco Bell
(no).

No further public comment was offered; Chair Rhody closed the public hearing.

Motion #1: Member Rhody moved, second by Member Duncan, to recommend approval of the request by
Heritage Realty Management, Inc and Border Foods (PF2390) to amend Planned Unit Development #1199
allowing an additional 20 square foot sign on the north facade at 1101 Larpenteur Avenue.

Ayes: 5, Rhody, Olson, Duncan, Cunningham, Mulder

Nays: 0

Motion carried.

This request will be forwarded to the Roseville City Council for action on March 12, 2001.

Member Duncan said staff comment #4.3 regarding hours should be more specific to measure impacts.

Member Mulder noted that the Commission had previously recommended only the Council review these
performance issues. (Mr. Erickson said he had no objection).

Member Cunningham noted that the Taco Bell drive-through vehicle impact on the neighborhood by headlights was
negligible. The hours should be left to the marked.

Member Cunningham was in favor of the motion.

Member Olson was in favor with yearly review.

Motion #2: Member Mulder moved, second by Member Rhody, to recommend approval of the increased hours of
operation from 9:00 a.m. to 2:00 a.m. weekdays and weekends for the Taco Bell, 1101 Larpenteur Avenue, with an
annual (two year) review in December 2001 and 2002 by the City Council with appropriate action taken.

Ayes: 5, Rhody, Olson, Duncan, Cunningham, Mulder

Nays: 0

Motion carried.

This request will be forwarded to the Roseville City Council for action on March 12, 2001.

c.
