Member Mulder spoke in favor. <br /> <br />Motion: Member Mulder moved, seconded by Member Rhody, to recommend approval of a 176 square foot variance <br />from Section 1004.01 A5 to allow construction of a detached accessory building 1,008 square feet in size for property <br />located at 1166 Laurie Road, based on the comments and findings in Section 3, 4, and 5 of the project report dated <br />August 8, 2001. <br /> <br />Ayes: 5, Wilke, Duncan, Mulder, Rhody, Traynor <br /> <br />Nays: 2, Cunningham, Olson <br /> <br />Motion carried 5-2. <br /> <br />6(c) Planning File 3333: A request by Roseville Covenant Church for a Variance from Section 1 004.02A4 of the <br />Roseville City Code to allow use of a home, closer than 30 feet from adjacent residential uses, for church purposes. The <br />property is located at 1380 County Road C2. <br /> <br />Chair Rhody opened the hearing and requested Thomas Paschke to provide a verbal summary of the project report dated <br />July 11, 2001. <br /> <br />Roseville Covenant Church is requesting a 23-foot variance from Section 1 004.02A4 of the City Code to establish a <br />church use in structure closer than 30 feet to an adjacent residential lot. <br /> <br />Roseville Covenant Church, 2865 Hamline Avenue, intends to purchase the property (a duplex) at 1380 and 1382 County <br />Road C2 for the utilization of church office and storage. The property is zoned R-2, Two Family Residence District; <br />located in Planning District 3; and given a Comprehensive Plan Future Land Use Map designation of Low Density <br />Residential. <br /> <br />Mr. Paschke noted this is a pre-existing, permitted condition. Moving the structure to meet the setback is unreasonable. <br />He recommended approval. <br /> <br />Member Mulder asked if the Church could add on to the site. (The Church can use all of the structure, but to change the <br />structure, the Church must meet the Code). <br /> <br />Member Wilke asked if the Church is tax exempt; does the property become tax-exempt? (yes); assessments do apply. <br /> <br />The applicant had no comment. <br /> <br />Merle Grundum, 2280 Sheldon, was opposed to the Church taking over the property because of church property <br />maintenance including weeds and screening HVAC. <br /> <br />Chair Rhody closed the hearing. <br /> <br />Member Wilke recounted how HVAC on the north side of the building was not favorably reviewed in prior years. Staff must <br />review the existing site and conditions attached to the Church. <br /> <br />Motion: Member Mulder moved, seconded by Member Wilke, to recommend approval of the request by Roseville <br />Covenant Church for a 23-foot variance to Section 1 002.02A4 of the Roseville City Code, based on the comments and <br />findings in Section 3 of the project report dated August 8, 2001. <br /> <br />Ayes: Rhody, Cunningham, Traynor, Wilke, Olson, Duncan, Mulder <br /> <br />Nays: None <br /> <br />Motion carried 7-0. <br />
