<br />The Commission asked for details of why property owners were not issued permits. <br /> <br />Member Mulder said he understood the uniqueness of the site as it relates to the PUD. The challenge is that there has <br />been significant investment, but isn't there additional space on the site for the building. <br /> <br />Member Peper asked if the siding was changed (Yes, to vinyl). <br /> <br />Chair Duncan noted little response from owner, and costliness of reducing the size of the driveway. <br /> <br />Member Traynor agreed with the concerns of Members Mulder and Duncan. <br /> <br />Member Mulder asked if staff encourages this type of request. <br /> <br />Is the site better today with the improvements or left as was with no improvements? <br /> <br />Paul Rudolph, manager of the site, explained that the Pigeon Club has attempted to improve the premises. The shed and <br />garage were there when purchased. The new shed is 6' x 20'. The new driveway was done by a contractor, without a <br />permit. They have worked with the neighbors. <br /> <br />Bob Korn, President of Viking Racing Pigeon, noted the site was purchase in 1975. There have been no complaints prior <br />to 1995. <br /> <br />Mr.Korn noted that on April 26th the old shed was moved out. The concrete contractor removed all sidewalks and <br />blacktop. A concrete pad was built to hold the new shed east of the garage. The shed was resided. The property owners <br />to the south did not like further privacy fencing, but more fencing. He requested removal of the old southerly shed. Mr. <br />Korn showed pictures of the new driveway, including driveway turn-around at the rear of the site. A lawn care service has <br />been hired to manage the site. <br /> <br />The Club parks on the west side of the street, not in front of any homeowners, as well as overflow parking in the American <br />Legion Club lot. <br /> <br />Member Mulder asked if there is a shrubbery planting plan (Neighbor to south thinks it looks good now). Planting along <br />east side of shed would be on a sloped right-of-way. (There is no shrubbery setback requirement). <br /> <br />AI Jensen, 690 W. County Rd C, said the shed is an improvement. The lawn and house look better. The "Rosetown" sign <br />is ugly. <br /> <br />Barbara Berke, 728 w. County Rd C, said the property update has been an improvement and she appreciated the new <br />work. She has no issue with the variance. <br /> <br />Debby Perry, 720 County Rd C, said she has no complaints regarding the improvements. <br /> <br />Rover Hesteen., 269 Rosetown Court, said what happens to the Club property most impacts his property visually. He felt <br />they have acted in good faith and been cooperative. The east side of the garage is the best location for the new shed (as <br />now located). It is an asset. <br /> <br />Member Mulder said he felt the Club acted in good faith and he will support the variance. The driveway appears to be of <br />similar size to the old drive. Part of the issue was the conversion of the Legion drive to a road which was beyond there <br />control. The property looks better. <br /> <br />Member Traynor said he will support it based on hardships for placement of the shed elsewhere on the site. He <br />complimented applicant and neighbors. He asked staff to review contractor licenses for not getting permit. <br /> <br />There being no further comments, Chair Duncan closed the hearing. <br /> <br />Motion: Member Mulder moved, seconded by Member Peper, to recommend approval of the request by Viking <br />Pigeon Club for a variance to Section 1004.02D4 (Yard Requirements - Setbacks) and Section 1004.01A6 <br />(Maximum Total Surface Area) of the Roseville City Code, based on the findings of Section 6 and conditions of <br />Section 7 of the project report dated July 10, 2002, as follows: <br />a. A property survey indicating all structures, driveway and sidewalk, and their dimensions and square footage. <br />b. The shed being screened with a year round landscaping on the south and a portion of the east of the property <br />
