<br />VARIANCE to Section 1005 of the Roseville City Code to allow for the reuse of 2154 North Lexington <br />Avenue site as a gas/convenience store. <br /> <br />Chair Duncan opened the hearing and requested Thomas Paschke provide a summary of the staff report dated <br />June 4, 2003. <br /> <br />Muna Sabri, dba Jordan Stop, 2154 Lexington Avenue, has contracted to re-open a gas station (formerly Jiffy Gas) <br />on a pre-existing non-conforming site. As a result, Mr. Sabri seeks approval of a Conditional Use Permit and <br />multiple Variances to allow the re-use on the site. <br /> <br />The property at 2154 Lexington Avenue has been operated as a motor fuel and limited convenience facility as <br />recently as 2001. The owner of record is QC Energy II of Rockford, Illinois. However, since the use on the site <br />ceased to operate for more than one year the property is classified as non-conforming use, requiring both a <br />conditional use permit per Section 1 005.05.C6 and Section 1013 and a variance to (multiple) Section 1005 of the <br />City Code. An abatement hearing to clean up the vacated site was held by the City Council on June 10, 2002. The <br />site also has three ground water pollution monitoring wells, monitored by the Minnesota Department of Health. <br /> <br />Staff recommended approval of the variance and conditional use permit with conditions. <br /> <br />Member Bakeman asked if the County will take more land for the intersection. Deb Bloom explained that the <br />County has no plans for added right-of-way. <br /> <br />IlIia Teska explained the proposal for Jordan Stop. The applicant agrees with the staff report, except for the hours <br />of operation which should be expanded to 24 hours/day. <br />Chair Duncan closed the hearing. <br /> <br />Motion: Member Duncan moved, seconded by Member Peper, to recommend approval of a CONDITIONAL <br />USE PERMIT for Muna Sabri and QC Energy II to allow the reuse of 2154 Lexington Avenue as a gas station <br />with limited convenience sales, based on the information contained in Section 5 and conditions of Section <br />7 of the project report dated June 4,2003, and modifying Section 7.7 of the staff report dated June 4,2003, <br />to indicate approval of 24 hours of operation per day. <br /> <br />Ayes: 5 <br />Nays: 1, Bakeman <br />Motion carried. <br /> <br />Motion: Member Duncan moved, seconded by Member Peper, to recommend approval of a variance to <br />Section 1005.0A2, 1005.01A3, 1005.01D6B, 1005.09C, 1005.09E and 1010.14 of the Roseville City Code, for <br />Muna Sabri, and QC Energy II to allow the re-use of 2154 Lexington Avenue as a gas station with limited <br />convenience sales, based on the findings in Section 6 and conditions of Section 7 of the project report <br />dated June 4, 2003, with elimination of Section 7.7 of said report. <br /> <br />Ayes: 5 <br />Nays: 1, Bakeman <br />Motion carried. <br /> <br />Member Bakeman objected based on hours and noise as annoying. C <br /> <br />Member Stone recused herself from the discussion of item 7a <br /> <br />Thomas Paschke indicated that Ramona Mogg and Bob Moser seek the Planning Commission's comments and <br />direction regarding their redevelopment proposal to develop the Mogg property with three town home structures <br />with two units each. The proposed project consists of approximately 4.4 acres with a total of seven housing units in <br />a Planned Unit Development (PUD) consisting of the existing Mogg home and 6 town homes. The townhome <br />structures will be a rambler walkout to reduce height impacts on the adjacent neighbors. Access would be from a <br />private drive utilizing the existing access to County Road C. The structures would be built along a southwest facing <br />wood slope overlooking the City's nature center. <br /> <br />Thomas requested the Commission provide comment and direction regarding the attached plans and narrative to <br />staff and the applicants. This is the first step in a 60 to 120 day planning process. The Commission will see this <br />proposal again, with refinements, at a public hearing later this year. <br /> <br />Ramona Mogg explained the site history since 1963 and the proposal. She explained she has no problems with <br />
