<br />AC units must be placed on the south side of the town home; and on Lots 1 and 8, AC units must be placed on the <br />north side of the town home. AC units located on Lots 1, 4, 5, and 8 must be screened from view and include <br />reduced noise levels. <br /> <br />G. The existing water well must be properly capped and all buildings, tree branches and roots, debris, and any soil <br />contamination (subject to MnPCA requirements) must be removed from the site (not burned on the site) prior to the <br />issuance of a building permit. <br /> <br />H. Park dedication is required. Staff recommends for this development cash payment in lieu of land dedication. The <br />payment amounts to $1,000 per unit or $8,000. The Park and Recreation Commission will review this before final <br />approvals. <br /> <br />I. The Comprehensive Land Use Plan Amendment from LR to MR conditioned upon the review and support of the <br />Metropolitan Council. <br /> <br />J. Planning File 3549: Request by Christopher & Noelle Olson for a Variance from Section 1004.01 A7 and <br />Conditional Use Permit in accordance with Section 1 004.01A4 of the Roseville City Code, for property <br />located at 2940 Old Highway 8. <br /> <br />Chair Mulder opened the hearing and requested the City Planner present the verbal summary of the staff report <br />dated March 3, 2004. <br /> <br />Thomas Paschke explained that Chris/Noelle Olson, 2940 Old Highway 8, seek approval of a 54 foot Variance from <br />Section 1004.01A7 (Location) and a Conditional Use Permit in accordance with Section 1004.01A4 of the Roseville <br />City Code to allow the construction of a 980 sq. ft detached garage in the front yard. <br /> <br />The applicant seeks approval of a 980 sq. ft detached accessory building that would increase the impervious total <br />on the parcel to approximately 4,669 sq. ft. The accessory building square footage exceeds the size of the home. <br />Staff calculated the home to be 1,150 sq. ft., the attached garage to be 230 sq. ft., and the proposed detached <br />accessory building to be 980 sq. ft. This gives the parcel a proposed total accessory building square footage of <br />1,210 sq. ft. or 60 sq. ft. over the parcel's allowance. Staff did not recommend a Variance to allow the overage. <br /> <br />Thomas Paschke explained setbacks allowed within the front yard for a principle structure. <br /> <br />Staff reviewed this proposal and determined that it is difficult to justify a departure from the strict application of <br />Section 1004.01A5 (Overall Area) of the City Code allowing the applicant to construct a 980 sq. ft. detached <br />accessory building. The Staff recommended not issuing a Conditional Use Permit. The Staff determined there is <br />justification for reducing the accessory building to 26 feet by 32 feet or 832 sq. ft., which eliminates the need for a <br />Conditional Use Permit and eliminates the need for one Variance to Section 1 004.01A5. It does, however, require a <br />Variance to Section 1004.01 A7 (allowance in front yard). <br /> <br />The Staff recommended approval of a Variance to Section 1 004.01A7 (Location) and a 3 foot Variance to Section <br />1004.02D5 (Dwelling Dimensions - Side Yard Setback) of the Roseville City Code for Chris/Noelle Olson to allow <br />the construction of a detached accessory building in the front yard at 2940 Old Highway 8, based on the findings in <br />Section 5 of the project report dated 03/03/04, and the following conditions: <br /> <br />a. The attached garage being limited to a depth of 26 feet, a length of 32 feet, and an overall size of 832 sq. ft. <br /> <br />b. A minimum side yard setback not to encroach closer than 7 feet to the side yard (north) property line. <br /> <br />c. A minimum front yard setback of 30 feet. <br /> <br />d. Impervious coverage being limited to 7,431 square feet. <br />
