<br />Member Traynor found that there is an appropriate alternative and he will not support the proposal. <br /> <br />Member Bakeman also will not support the proposal; too many walls and clutter along Victoria and an option exists. <br /> <br />Vice Chair Mulder also will oppose the variance because an option exists that does not require a separate motion. <br /> <br />Motion: Member Bakeman moved, seconded by Member Traynor, to recommend denial of a Variance to <br />Section 1004.01A7 of the Roseville City Code for Kenneth Berger, based on the findings that options are <br />available to add on to the existing garage and property can be put to a reasonable use without a variance. <br /> <br />Ayes: 3, Mulder, Traynor, Bakeman <br />Nays: 2, Peper, Ipsen <br />Motion carried. <br /> <br />c. Planning File 3467: Request by Starbucks coffee, 2305 Fairview, for a Conditional Use Permit to allow <br />construction of a drive-through service window at Fairdale Shop pes. <br /> <br />Acting Chair Mulder opened the hearing and requested City Planner Thomas Paschke provide a summary of the <br />project report dated May 7,2003. <br /> <br />Thomas Paschke advised that Starbucks' Corporation in cooperation with Walpert Properties (property owner) was <br />seeking approval of a conditional use permit to allow the installation of a new drive-thru window and order board at <br />their fast food convenience restaurant at 2305 Fairview Avenue North. The property is currently occupied by a <br />1,600 square foot coffee shop/cafe. The recently amended City Code identified this type of use as a Class II <br />Restaurant or Fast Food Convenience. The existing structure has 30 seats, approximately 45 off-street parking <br />spaces are allotted to this area, and there is room for a drive-thru with a stacking capacity of six vehicles. He <br />explained the traffic flow improvements, angle parking and islands. <br /> <br />Based on findings, staff recommends approval of the request for a conditional use permit to allow the construction <br />and operation of a new drive-through facility at Starbuck's 2305 Fairview Avenue North, subject to the following <br />conditions: <br /> <br />a. Submittal of a revised site, lighting and landscape plan including the three curbed islands similar to the plan <br />designed by Staff (05/07/03); the design of angle parking in the south parking lot; parking and building lighting <br />meeting Section 1010.12 of the City Code; additional plantings along the west and south property line, including <br />trees consistent with the City's Street Tree Master Plan. <br />b. Minor variations from the approved plans may be approved by the City's Development Review Committee, under <br />the direction of the Community Development Director; however, any substantial departures from the approved <br />plans will require an amendment to the conditional use permit. <br />c. All signage, including the menu board, for the project must comply with the requirements of Section 1009 of the <br />City Code, including the size and location of wall signs, monument sign, and directional signs. <br />d. The curb along the front of the property shall be repaired and/or replaced. Paving must be repaired by mill and <br />overlay or other technique approved by the Public Works Director. Because of the cars that will line up to use the <br />window, pedestrian access from and through the parking lot must be clearly marked at the entry point by painting <br />the pavement surface and caution signage near the front door of the building. The site plan, curbs, islands and <br />signage will be worked out with staff. <br />e. Prior to a building permit being issued for redevelopment of the site, the applicant shall post a landscape bond, <br />letter of credit or other security acceptable to the City, in an amount equal to 150% of the cost of landscaping, trash <br />enclosures, and site paving and curbing restoration. The specific amount of this security shall be determined by the <br />Community Development Director following completion of all site construction plans. <br />f. The applicant shall record the approved conditional use permit with the Ramsey County Recorder prior to the <br />issuance of any building permit or within sixty days of approval, whichever is less (Section 1 013.01-City Code). <br />g. The conditional use permit shall expire within six months of the date of City Council approval if a building permit <br />is not obtained for the approved development (Section 1013.03 of the City Code). <br /> <br />Vice Chair Mulder asked for details of vehicle stacking areas and asked if all parking should be counter-clockwise, <br />one-way traffic with angled parking. <br /> <br />Member Peper suggested a one-way as per McDonalds, Arbys, etc. Thomas Paschke explained his review of <br />traffic concerns. <br /> <br />Tom Banks, Chicago Starbucks, proposed all one-way traffic in a counter-clockwise manner with stop signs and <br />islands. <br /> <br />Member Peper asked if there is a difference between staff and Mr. Bank's proposal. Staff can refine the design with <br />Starbucks. Islands are to be curbed, low and landscaped. <br />
