<br />of the shelter. The Public Works Director shall determine the location of shelters to assure <br />line of sight and traffic safety. Signage on benches and shelters shall require permits as <br />required by Chapter 1009. <br /> <br />G. Structure Maintenance: Benches and shelters shall be equipped with an architecturally <br />complimentary trash receptacle to be emptied weekly or as frequently as necessary by the <br />vendor to comply with the City's health, safety and welfare concerns. <br /> <br />H. Liability Insurance: A certificate of liability insurance shall be filed with the City covering <br />claims for damages which might arise out of the use or placement of a bench or shelter in the <br />public right of way naming the City as an additional insured. The minimum limit of liability <br />shall be six hundred thousand dollars ($600,000.00). <br /> <br />1. Removal: At the request of the Public Works Director, a bench or shelter shall be removed in <br />order to permit right-of-way improvements or maintenance. If the location of the bench or <br />shelter)s a safety hazard or if it interferes with pedestrian or vehicular traffic on the right of <br />way, or if the bus route changes, the provider shall incur the cost of removal within 30 days <br />of the route change. <br /> <br />J. State Or County Permission: If the bench or shelter placement is in a Minnesota Department <br />of Transportation or County right of way, written permission must be secured from the <br />Minnesota Department of Transportation or the County and filed with the City. (Ord. 921, 2- <br />14-1983; 1995 Code) <br /> <br />SECTION 3. Section 1009.03 is hereby amended as follows: <br /> <br />F. Public Ways: Signs shall not be permitted within the public right of way or easements except <br />on benches and shelters which have received permits as per Section 703.05 , and newspaper <br />and cabstands, all of which shall be as governed by Section 901 and Section 703.05 of this <br />Code; and real estate signs and political signs as regulated in this chapter. City, county and <br />state traffic directional signs are permitted. <br /> <br />SECTION 4. Effective Date.
