If a street lighting ballot is initiated, the following process should be used: <br /> <br />Ballot Process <br /> <br />1. Upon receipt of a request for ballot signed by the owners of 20% of the <br />property in the project area, City staffwill prepare a preliminary report <br />detailing the streetlight types, location, costs, proposed assessments and <br />estimated S~etlight Utility fees. <br />2, City staffwi11 forward project cost information to the neighborhood or <br />commercial representative. The representative will be responsible to gain <br />consensus of the project area for the chosen streetlight type within 90 <br />days. <br />3. Upon receipt and review of the decision on the streetlight type, staff will <br />prepare and mail to each property owner a ballot. The ballot will include <br />assessment and Streetlight Utility fee information for the streetlight type <br />selected for the project area and a map detailing the location of the <br />streetlights. A postage paid return envelope will be included with each <br />ballot. <br />4. Property owners will have twelve (12) working days to return their ballot. <br />The return date will be indicated on the ballot. Ballots will be accepted if <br />post-marked by the return date. Staffwill work with the neighborhood or <br />commercial representative to help facilitate the return of as IIlll1lY ballots <br />as possible. <br />5. All returned ballots will be tabulated. If greater than fifty percent (50%) <br />of the owners of property in the project area return ballots indicating <br />support of the project, a feasibility study report will be prepared and <br />Council will be asked to call and hold a public hearing pursuant to <br />Minnesota Statutes, Section 429.031. <br />6. If the project goes to the public hearing, but is not ordered forward, <br />subsequent balloting procedures will not be undertaken for the same <br />project area or any part of the project area for a two (2) year period. If the <br />project does not proceed to a public hearing because the required threshold <br />of support of greater than 50% of the owners of property is not met, no <br />subsequent balloting procedures will be undertaken for a two (2) year <br />period beginning on the return date on the ballots. The exception to this <br />requirement would be if the City initiates a street reconstruction project in <br />the area. <br />
