The type of design features to be used in each Theme Area shall be determined when the first street lighting proj ect in the theme areas is initiated in these areas. The design features may be recommended by developers in the case of new developments and by the property owners in existiIlg developments. AIl Theme Area design features shall be subject to the review of City staff and approval of the City Council. IV. PROCEDURE The following procedures are estsblished for the initiatioD and approval of street lighting: A. When a request for street lighting is received, City staff, working with property owners, will determine the boundaries of a proj ect. B. Requests for street lighting can be initiated through the fOllowing methods: 1. Submittal ofa petition that includes the signatures of the owners of 60% ofllie property in the project area. 2. Submittal of a request for a street lighting ballot that includes the signatures of the owners of20% of the property in the project area. C. If a streetlight petition is submitted, the following process should be used: Petition Process 1. Upon receipt of a petition signed by the owners of sixty percent (60%) of the property in the project area, City staff will prepare a prelim;n~'Y report detailing the streetlight types, location, costs, proposed assessments and estimated Streetlight Utility fees. 2. City staffwill forward project cost informatioD to the neighborhood or commercial representative. The representative will be responsible to gain consensus of the project area for the chosen str~tlight type within 90 days. 3. Once consensus has been reached, the City Council will be asked to call and hold a public hearing pursuant to Minnesota Statutes, Section' 429.031. 4. If the project goes to the pUblic hearing, but is not ordered forward, subsequent petitions will not be undertaken for the same project area or any part of the project area for a two (2) yearpenod beginning on the hearing date. The exception to this requIrement would be if the City initiates a street reconstruction project in the area.
