The type of design features to be used in each Theme Area shall be <br />determined when the first street lighting proj ect in the theme areas is <br />initiated in these areas. The design features may be recommended by <br />developers in the case of new developments and by the property owners in <br />existiIlg developments. AIl Theme Area design features shall be subject to <br />the review of City staff and approval of the City Council. <br /> <br />IV. PROCEDURE <br /> <br />The following procedures are estsblished for the initiatioD and approval of street lighting: <br /> <br />A. When a request for street lighting is received, City staff, working with property <br />owners, will determine the boundaries of a proj ect. <br />B. Requests for street lighting can be initiated through the fOllowing methods: <br />1. Submittal ofa petition that includes the signatures of the owners of 60% <br />ofllie property in the project area. <br />2. Submittal of a request for a street lighting ballot that includes the <br />signatures of the owners of20% of the property in the project area. <br /> <br />C. If a streetlight petition is submitted, the following process should be used: <br /> <br />Petition Process <br /> <br />1. Upon receipt of a petition signed by the owners of sixty percent (60%) of <br />the property in the project area, City staff will prepare a prelim;n~'Y report <br />detailing the streetlight types, location, costs, proposed assessments and <br />estimated Streetlight Utility fees. <br />2. City staffwill forward project cost informatioD to the neighborhood or <br />commercial representative. The representative will be responsible to gain <br />consensus of the project area for the chosen str~tlight type within 90 <br />days. <br />3. Once consensus has been reached, the City Council will be asked to call <br />and hold a public hearing pursuant to Minnesota Statutes, Section' <br />429.031. <br />4. If the project goes to the pUblic hearing, but is not ordered forward, <br />subsequent petitions will not be undertaken for the same project area or <br />any part of the project area for a two (2) yearpenod beginning on the <br />hearing date. The exception to this requIrement would be if the City <br />initiates a street reconstruction project in the area. <br />
