<br />- <br /> <br />K1\uy <br /> <br />c-) \, Ccck',: ..J~c <br />;'J < <br /> <br />CHAPTER 72 <br /> <br />street Light utility System <br /> <br />72.01 System Established. A city street lighting system is <br />hereby established. The system includes all existing and future <br />street lights located on public streets and pathways, but not to <br />include sight lighting for residential, commercial or other <br />property. This system will commence operation on January 1, 1992 <br />and will continue indefinitely or until Council takes action to <br />terminate the program. <br /> <br />72.02 Council Action. The Council shall determine by <br />resolution from time to time, the streets, alleys or other pUblic <br />areas on which the city shall install and operate street lighting <br />systems. Before any such service is furnished pursuant to such <br />resolutions, the Clerk shall, under the Councils direction, <br />publish notice that the Council will meet to consider such <br />projects. Such notice shall be published in the official <br />newspaper at least once no less than ten (10) days prior to such <br />meeting of the Council and shall state the date, time and place <br />of such meeting, the streets, alleys or other public and private <br />areas affected by and the particular projects proposed and the <br />estimated cost of each project, either in total, on the basis of <br />the proposed assessment per front foot, or otherwise. <br /> <br />72.03 Waiver of Public Hearing. Whenever 100% of the <br />property owners of one or more sUbdivisions, platted or in the <br />process of platting, shall desire to have a street lighting <br />system within all or a portion of the said subdivision or <br />subdivisions, all of the said property owners may execute a <br />waiver of the hearing requirement set forth in this ordinance. <br />Upon the city's receipt of the said executed waiver by all <br />property owners having an interest in the subdivision or <br />subdivisions, the Council may at its discretion order the <br />installation of a street lighting system within said subdivision <br />or subdivisions. Payment of all charges for said street lighting <br />system within said subdivision or subdivisions shall be paid for <br />out of the street light utility fund. <br /> <br />72.04 Costs of the System. The costs of the street <br />lighting system are the actual costs as billed to the city by the <br />pUblic utility, plus a certain percentage for incidental costs <br />which include administrative, maintenance, inflation and growth. <br /> <br />72.05 Billincr. The service charge will be included as a <br />separate line item on the existing water and sewer bill. <br /> <br />72.06 DeJincruent Accounts. All charges for street lighting <br />shall be due on the date specified by the Finance Department for <br />the respective amount, and shall be delinquent thereafter. A <br />penalty of 1% will be added to all delinquent accounts. <br />
