Procedure <br /> <br />When a request for an "Enhanced Street Lighting" project is received, City staff, working <br />with property owners, will determine the boundaries of the project. Requests for street <br />lighting can be initiated through the following methods: <br /> <br />. Property owners shall submit a petition that includes signatures representing at least <br />60% of the property in the project area. <br /> <br />· Property owners shall submit a request for a street lighting ballot that includes <br />signatures representing at least 20% of the property in the project area. <br /> <br />Petition Process <br />If a street light petition is submitted, the following process should be used: <br /> <br />· Upon receipt of a petition signed by the owners of sixty percent (60%) of the property <br />area within the proposed project limits, City staff will prepare a preliminary report <br />detailing the streetlight types, location, costs, and proposed assessments. <br /> <br />· The City Council will be asked to call and hold a public hearing pursuant to <br />Minnesota Statutes, Section 429.031. <br /> <br />· If the project goes to the public hearing, but is not ordered forward, subsequent <br />petitions will not be undertaken for the same project area or any part of the project <br />area for a two (2) year period beginning on the hearing date. The exception to this <br />requirement would be if the City initiates a street reconstruction project in the area. <br /> <br />Baffel Process <br />If a street lighting ballot is initiated, the following process should be Hsed: <br /> <br />· Upon receipt of a reqHest for ballot sigHed by the owners of twenty percent (20~q of <br />the property area within the proposed project limits, City staff 'Nill prepare a <br />preliminary report detailing the streetlight types, location, costs, and proposed <br />assessments. <br /> <br />· Staff will prepare and mail to each property owner a ballot. The ballot will include <br />assessment inforn1ation for the street light tj'j3e selected for the project area and a map <br />detailing the location of the streetlights. A postage paid return envelope v..ill be <br />inc1Hded with eaeh ballot. <br /> <br />· Property owners will have twebe (12) working days to return their ballot. The retHrn <br />date will be indicated on the ballot. Ballots will be accepted if post marked by the <br />return date. Staff '.viII '.vork the neighborhood or commercial representative to help <br />facilitate the retlJlll of as many ballots as possible. <br /> <br />· ,^,ll retHrned ballots will be tabHlated. If greater than sixty percent (60~q of the <br />owners of property in the project area return ballots indicating support of the project, <br />a f-casibility stHdy report '.viII be prepared and COHncil 'Nill be asked to call and hold a <br />public hearing pumuant to Minnesota Statutes, Section 129.031. <br />
