City of Roseville - Planning Commission Agenda for April 6, 2005 Page 2 of 4

Code. Specifically the newly created parcel will have a front and yard setback of up to 50 feet, a side yard setback of
10 feet, and an impervious coverage of 30% or 2,754 sq. ft.

The Community Development Staff recommended approval of a 25 foot lot width variance and a 1,820 sq. ft. lot size
variance to Section 1004.016 (Residential Dimensional Requirements) for new Parcel "A", and 25 foot lot depth and
a 1,580 sq. ft. lot size variance Section 1004.016 (Residential Dimensional Requirements) for pre-existing non
conforming Parcel "B", and a minor subdivision to allow the creation of two substandard residential parcels for
property located at 1758 Alta Vista Drive based on the findings in Section 5 of the project report dated April 6, 2005
and the following conditions:

a. The City policy is to require payment of the Metro Area Sewer Availability Charge (SAC) upon the issuance of a
building permit. In this case, a $1,350 SAC fee is required and will be collected with the issuance of a building permit
for Parcel "A".

b. The applicant must record the two lot minor subdivision survey within 60 days after the approval of the City
Council.

c. The applicant must apply for and receive a driveway access permit for Ramsey County prior to issuance of any
building or grading permit.

d. A grading plan and the survey must be submitted with the building permit application.

e. The applicant is responsible for "payment in lieu of land dedication" amounting to $1,000 for the newly created
parcel in accordance with the City Code regarding park dedication. (To be reviewed versus the new dedication
ordinance by the City Attorney)

Member Bakeman asked for the lot sizes adjacent to the site. (Similar in lot width 60 feet and depth 150 feet) Staff
was asked to review the park dedication requirement with the City Attorney. The Commission corrected the
dimensions incorrectly noted in the staff report. The driveway will be 50 feet in length. The house will be a maximum
of 40 feet in width, with 10 foot setbacks on both sides.

Member Boerigter asked for clarification of lot size and variances requirements (past and current practice). Thomas
Paschke explained the precedent in the neighborhood, where nearby lots did not receive variances. Member
Bakeman asked if Ramsey County has made a recommendation for right-of-way on Dale Street and if the staff
would research the issue with the County.

Mr. Jim Beauclaire explained the history of the lot and previous approvals for adjoining lots. Chair Traynor asked
how the site will be graded. Mr. Beauclaire proposes a tuck under garage, set high on the slope of the site.

Jeff Beaukamp, 1747 Dale, said there are surface water problems. There is no sewage line along Dale Street.
Sewage must be pumped to the west to Alta Vista. He said the soil is all sand. He asked if the City will consider a
new sewer line along Dale Street because of the failure of pumped sewage to Alta Vista. A private easement or
lateral extension through the existing lot will be required along an east-west lot line.

Chair Traynor closed the public hearing.

Member Bakeman supported the lot split but requested that the side yard setbacks should not be reduced from ten
feet except by variance and demonstration of hardship. Chair Traynor supported the request because it is consistent
with the neighborhood context.

Motion: Chair Traynor moved, seconded by Member Bakeman, to recommend approval of a 25 foot lot width
variance and a 1,820 sq. ft. lot size variance to Section 1004.016 (Residential Dimensional Requirements) for
new Parcel "A", and 25 foot lot depth and a 1,580 sq. ft. lot size variance Section 1004.016 (Residential
Dimensional Requirements) for pre-existing Parcel "B" for property located at 1758 Alta Vista Drive based
on the findings in Section 5 of the project report and subject to the conditions within Section 6, including 6.1
(e) (payment of park fee by applicant, if required after attorney review) and 6.1 (f) (if requested, side yard
variances will be required rather than setback permits) report dated April 6, 2005.

Ayes: 6
Nays: 0
Motion carried

Motion: Chair Traynor moved, seconded by Member Bakeman, to recommend approval of a minor
subdivision (Three Parcel Minor Subdivision) to allow the creation of two substandard residential parcels
("A" and "B") for property located at 1758 Alta Vista Drive, based on the findings in Section 5 and subject to
the conditions of Section 6 including 6.1(e) (payment of park fee by applicant, if required after attorney
review) and 6.1 (f) (if requested, side yard variances will be required rather than setback permits] of the

http://www.ci.roseville.mn.us/councillplanning/minutes/2005/pm050406.htm

6/20/2005
