City of Roseville - Planning Commission Minutes for January 4, 2006http://www.ci.roseville.mn.us/council/planning/minutes/2006/pm0104.htm <br />is the Service Road and Interstate 35W; east is the Roseville West Building (office), zoned Retail Office <br />Service District; and west is Northstar Financial Forms (printing), zoned Light Industrial. <br />The process to allow Bonten, Inc. to proceed forward with their request is complicated and requires a <br />specific sequence of events to occur. Specifically, the Public Works Department will not support the <br />VACATION of EASEMENTS unless it is confident that the volume of the pond will not change. The pond <br />cause flooding upstream or downstream. To ensure that the proposed redesign will not impact other <br />properties, the City hired SEH, Inc. to complete a review of the pond modeling and redesign provided by <br />conjunction with the EASEMENT VACATION and PRELIMINARY PLAT requests: <br />Execution of an easement between Bonten, Inc and the City regarding any/all issues surrounding <br />the construction of a four store office building over two box culverts linking the south and north <br />bays of the pond. This easement agreement would be filed against the property and would follow <br />the land. <br />The easement agreement would include the conditions regarding the following: <br />Indemnification of liability should structural problems occur. <br />Indemnification of liability should flooding occur to any of the buildings on the Bonten Campus.For <br />looped driveway must be removed as part of the building permit. <br />Specific maintenance requirements if the slopes of the pond are steeper than 3:1. <br />The four story office building shall be constructed in such a manner that it bridges the box culverts <br />to ensure that the City could replace the box culverts with an open trench if necessary. <br />Retaining walls and all improvements to the land would be owned and maintained by Bonten, Inc. <br />have a legal description and be indicated on the FINAL PLAT. <br />A sidewalk shall be constructed along the east side of St. Croix Street to connect the east campus <br />with Terminal Road. <br />Execution of a Public Improvement Contract for the proposed public facility construction (pond <br />reconstruction & box culvert construction). This is a separate contract that deals solely with the <br />proposed public improvement. Once the new public facilities have been constructed and accepted <br />by the City of Roseville, the terms and conditions of the Public Improvement Contract will no <br />longer be valid. <br />The reconfiguration of the pond requires the elimination (VACATION) and re-dedication of certain pond <br />easements, all of which is tied to the SEH review and Roseville Public Works support. That being said, <br />certain existing pond easements can be VACATED and new easements dedicated on the PLAT for the <br />reconfigured pond.There was no further public comment. <br />The proposal by Bonten Inc. also requests a PRELIMINARY PLAT to combine 8 existing lots and/or <br />structure and parking.There was no further public comment. <br />The process of VACATING EASEMENTS & PLATTING LAND does not require associated site plan <br />approval. If the VACATION of EASEMENTS & PRELIMINARY PLAT are supported as indicated above <br />and approved by the City Council a FINAL PLAT is necessary and the proposed site improvements <br />require the applicant to submit plans and specifications consistent with the requirements of the Roseville <br />City Code, specifically Sections 1007 (Industrial Districts) and 1010 (Design Standards).There was no <br />further public comment. <br />The need for VARIANCES stems from the desire of Bonten, Inc to create three separate lots of <br />5 of 83/13/2006 8:52 AM <br /> <br />
