City of Roseville - Variance Board Minutes for August 4, 2004Page 2 of 2 <br />structure setback condition along County Road C. <br />Based on information received from Ramsey County Public Works and a site inspection. The Tile <br />Shop structure will now lie between 26.1 feet (east) and 27.9 feet (west) from the permanent <br />roadway easement. The required setback is 30 feet. He described the August 4th comments from <br />Fairview Roseville LLC attorneys. <br />Member Boerigter explained that he, as an attorney, has worked for one of the owners of the <br />Fairview/Roseville LLC, but had done no work for Fairview Roseville LLC. The Board accepted this <br />explanation as no conflict of interest. <br />The staff recommended approval of a 4 foot Variance to Section 1005.01 of the Roseville City Code <br />for The Tile Shop, 1803 County Road C, based on the findings in Section 5 and the following <br />conditions: <br />a.All future additions to the structure or use shall meet the required pre-existing setback <br />(estimated at 26’) from the revised property or public road easement line. <br />Thomas Paschke explained the differences proposed by the attorneys for the owners are more <br />explicit but that the last sentence from Fairview Roseville LLC should be stricken from the motion of <br />approval. <br />Member Boerigter asked if the County actually condemned (a taking) the site. He asked what would <br />occur if no variance was approved. <br />Chair Bakeman closed the hearing. <br />Motion: Motion by Member Boerigter, second by Member Doherty, to adopt a Resolution <br />approving a 4 foot Variance to Section 1005.01 of the Roseville City Code for The Tile Shop at <br />1803 County Road C, based on the findings in Section 5 and the conditions of Section 6.1 as <br />revised, with deletion of the last sentence, of the project report dated August 4, 2004. <br />Ayes: 3 <br />Nays: 0 <br />Motion carried: 3-0 <br />6.Rules of Procedure <br />The procedures to be used by the Variance Board were continued to September 1, 2004. <br />7.Adjournment <br />The meeting was adjourned at 5:50 PM <br />Return to Variance Board <br />http://www.ci.roseville.mn.us/council/variance/minutes/2004/vb0804.htm5/1/2006 <br />
