doesn’t usually mix; if it’s designated for a certain thing, that’s all it can <br />be used for. <br /> <br /> Member Neprash asked how big of a project it would be to put in the pipe <br />after the road has been reconstructed. Schwartz said it wasn’t that bad as <br />far as the construction, but the disruption would be major. Member <br />Neprash said maybe it would be worth talking to the residents to find out <br />if they wanted to wait so the street would only be torn up once in the next <br />three to five years. Member Fischer said he didn’t think Minneapolis & <br />St. Paul would give any kind of guarantee at this point that they would use <br />the Roselawn route. Member Neprash asked if there was a request for <br />action on the Commission’s part. Mr. Schwartz said no, that this was just <br />informational; but they could make a recommendation to the Council if <br />they chose to. <br /> <br /> Member Shiely moved to recommend to Council that residents on <br />Roselawn be able to vote on delaying the project to coincide with the <br />water interconnect project. Motion failed for lack of a second. <br /> <br /> Mr. Schwartz said to keep in mind that this is a joint project with Falcon <br />Heights, and the same option would have to be posed to their Council. <br />Mr. Schwartz said Falcon Heights has been very concerned that this job be <br />bid in March so there is enough construction time to finish the project <br />before the start of the State Fair. <br /> <br /> Member Fischer asked if there was a mechanism in place to take this issue <br />to residents for a vote. Mr. Schwartz said there wasn’t; staff would have <br />to come up with something, but first this recommendation would have to <br />go to Council. <br /> <br /> <br />5.Right-of-way Ordinance Draft Changes <br /> <br /> Mr. Schwartz presented the ordinance showing changes recommended by <br />the League of Minnesota Cities and asked for comments from the <br />Commission. Chair Wilke asked what the change really was. Schwartz <br />said now cities will now be responsible for service laterals but only on <br />new construction after January 2006 within the right-of-way. <br /> <br /> Member Fischer asked if anyone else has objected to the changes as yet. <br />Schwartz said he hasn’t heard anything but thought that most cities are in <br />the same situation as Roseville, just working on procedures of <br />implementation. <br /> <br /> <br />Page 4 of 6 <br />
