<br />1016.24: PLANNED UNIT DEVELOPMENT REQUIREMENTS: <br /> <br />O. Maintenance and Administration Requirements: Before final approval of a planned <br />unit development, adequate provisions shall be developed for preservation and <br />maintenance in perpetuity of open spaces and for the continued existence and <br />functioning of the development. <br />4. Erosion Control and St01111 Water Management: Erosion control and storm water <br />management plans shall be developed and the PUD shall be: <br />a. Designed, and the construction managed, to minimize the likelihood of serious <br />erosion occurring either during or after construction. This shall be acco111plished <br />by limiting the amount and length of time of bare ground exposure. Temporary <br />ground covers, sediment entrapment facilities, vegetated butIer strips, or other <br />appropriate techniques shall be used to minimize erosion impacts on surface water <br />features: and <br />b. Designed and constructed to effectively manage reasonably expected quantities <br />and qualities of st01111 water runotI. Impervious surface coverage within any lot <br />shailnot exceed twenty five percent (25%) of the tier area, except that for <br />commercial PUDs thirty five percent (35%) impervious surface coverage may be <br />allowed in the first tier of general development lakes with an approved storm <br />water management plan and consistency with this Chapter. <br /> <br />1016.25: GRADING, FILLING AND LAND ALTERATION: <br /> <br />A. Permit Required: No person, firm or corporation may engage in any excavation, <br />grading, surfacing or filling of land in the City without first securing a permit as set <br />f01ih in this Section. <br />I. Permit from City Engineer/Public Works Director: A permit is required from the <br />City Engineer/Public Works Director or designee, for any of the following activities: <br />a. Placement of or grading of more than ten (10) cubic yards of material on steep <br />slopes adjacent to lakes and wetlands or within the shore or bluff impact zones. <br />b. Placement of or grading of more than fifty (50) cubic yards of earthen material <br />anywhere in the City. <br />c. Where filling or grading occurs within ten feet (10') of a property line or when <br />such activity alters the drainage patte111s of adjacent propeliies. <br />2. Pennit from City Council: A permit from the City Council is required for any <br />projects meeting the following criteria: <br />a. Any fill, grading, or drainage of a public water or a wetland, provided the City <br />Council first determines that the project is either exempt from the 1991 Wetlands <br />Conservation Act or celiifies the replacement of any loss of wetland area, values <br />and functions in accordance with Mim1esota Rules, chapter 8420 as amended. <br />Questions relating to wetland type, location, area, functions and values must be <br />referred to the technical advisory panel established by Milmesota Statutes section <br />1030.2242 as amended. <br />b. For any filling or excavating on developed land zoned R-I or R-2 where the <br />site is less than one acre and the fill or excavation exceeds five hundred (500) <br />cubic yards. <br />
